Provisioning. 2.4.1 BellSouth shall provision services during its regular working hours. To the extent OneTone requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services Tariff, Section E13.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneTone, BellSouth will not assess OneTone additional charges beyond the rates and charges specified in this Agreement.
2.4.2 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇. ▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇ 13.3.1.
Provisioning. 29.6.1 After receipt and acceptance of an LSR, GTE shall provision such LSR in accordance with the following Intervals and in accordance with the service parity standards and other performance standards specified in Section 11 and Attachment 12.
29.6.2 GTE shall provide AT&T with service status notices, on a Real Time basis. Such status notices shall include the following:
29.6.2.1 Firm order confirmation, including service availability date and information regarding the need for a service dispatch for installation;
29.6.2.2 Notice of service installation issued at time of installation, including any additional information, such as material charges;
29.6.2.3 Changes/rejections/errors in LSRs;
29.6.2.4 Service completion;
29.6.2.5 Jeopardies and missed appointments;
29.6.2.6 Charges associated with necessary construction;
29.6.2.7 Order status at critical intervals;
29.6.2.8 Test results of the same type that GTE records for itself or its own customers.
29.6.3 GTE shall inform AT&T of overall change order flexibility and any changes thereto on a Real Time basis.
29.6.4 GTE shall notify AT&T prior to making any changes in the services, features or functions specified on the LSR. If an AT&T Customer requests a service change at the time of installation GTE shall refer the AT&T Customer to AT&T.
29.6.5 GTE shall provide provisioning support to AT&T on the same basis that it provides to other competitive LECs and to itself. GTE retains full discretion to control the scheduling of its provisioning workforce.
29.6.6 GTE shall provide training for all GTE employees who may communicate, either by telephone or face-to-face, with AT&T Customers, during the provisioning process. Such training shall include training on compliance with the branding requirements of this Agreement.
Provisioning. 2.2.1. Each Party shall provision services during its regular working hours. To the extent NSP requests provisioning of service to be performed outside OSP regular working hours, or the work so requested requires OSP’s personnel to work outside of regular working hours, overtime and premium charges shall apply, as specified in the Pricing Attachment of this Agreement.
2.2.2. Neither Party shall prevent or delay an End-User Customer from migrating to another carrier because of unpaid bills, denied service, or contract terms.
Provisioning. Provisioning is the set of activities required to install, change or disconnect a Customer’s service. It includes the functions to establish or condition physical facilities as well as the completion of any required software translations to define the feature functionality of the service. Provisioning also involves communication between SPRINT and VERIZON on the status of a service order, including any delay in meeting the commitment date and the time at which actual completion of service installation has occurred. Measurements in this category evaluate the quality of service installations, the efficiency of the installation process and the timeliness of notifications to SPRINT that installation is completed or has been delayed.
Provisioning. GTE agrees to provide UNEs and UNE-Ps in a timely manner, considering the need and volume of requests, pursuant to agreed upon service provisioning intervals. GTE shall provide power to ordered UNEs and UNE-Ps on the same basis as GTE provides power to itself. UNEs and UNE-Ps will be provided only when facilities are Currently Available. If facilities are not Currently Available, Gulf Coast will be notified and the order will be rejected. The determination of whether or not facilities are Currently Available will be made on a case-by-case basis. Gulf Coast may use the Bona Fide Request (BFR) process to request GTE to construct facilities at Gulf Coast’s expense. GTE will use the following guidelines to determine if facilities are Currently Available to provision a requested UNE or UNE-P:
4.4.1 GTE will not place new interoffice facilities or outside plant feeder or distribution facilities.
4.4.2 GTE will not breach existing interoffice facilities, outside plant feeder or distribution facilities or central office cabling or wiring to install new electronics or housing for plug-in electronic cards or modules. GTE will install new plug-in cards or modules when the housing already exists and is wired into the network.
4.4.3 In most circumstances, GTE will install drops and NIDs to connect outside plant facilities to an end-user’s premises to provide a UNE loop. GTE will use the same procedures its uses to determine when a drop would routinely be installed for a GTE Customer to determine if a drop will be installed for a UNE loop. Drops will not be installed when conditions such as excessive length, size of cable or use of fiber optics would require GTE outside plant construction personnel to install the drop.
4.4.4 GTE will not install new switches or augment switching capacity.
4.4.5 GTE will not install new software or activate software requiring a new right to use fee in switching equipment. GTE will activate software that is currently loaded in a switch but is not in use.
4.4.6 In certain situations, GTE utilizes pair gain technology, such as Integrated Digital Loop Carrier (IDLC)2 or analog carrier, to provision facilities. GTE may not be able to provision a loop UNE in such cases. Where GTE can provision a loop UNE using pair gain technology, the capabilities of such loop UNE may be limited. Provisioning. 3.7.3.1 Either party shall notify the other as soon as it becomes aware of any jeopardy condition which may arise that would jeopardize BellSouth’s committed due date or OC-TS, as applicable, of providing service to TCG.
3.7.3.1.1 Upon receipt of the FOC pursuant to Section 3.7.2.3.1, TCG shall notify the customer of the Due Date and or Due Time (OC-TS order). Either party shall notify the other party immediately if either party becomes unable to make the Hot Cut at the Due Time and / or on the Due Date specified. New scheduled due dates and times shall be within BellSouth’s normal hours of operations unless mutually agreed to by both parties.
3.7.3.1.2 Excluding facility shortages, acts of God or unforeseen force shortages, if BellSouth changes the date of a conversion from the date returned on the FOC, the new due date will be no greater than three (3) business days from the original requested date.
3.7.3.1.3 In the event BellSouth does not complete a conversion on the date returned on the FOC or does not complete a time specific conversion as requested due solely to BellSouth reasons, the following circumstances shall occur: (a) BellSouth shall document the order as a Missed Appointment pursuant to the appropriate service quality measurement outlined in Attachment 9 and incorporated herein by this reference and (b) TCG will not re-negotiate nor consider a change in due date and or due time as a re-negotiation; and (c) TCG will advise BellSouth to proceed as necessary to complete the cut; and BellSouth will not bill OCTS charges and TCG will not be required to pay for OCTS where a missed appointment of OCTS has occurred as provided for in the service quality measurements of Attachment 9 and incorporated herein by this reference.
3.7.3.1.4 Conversions that cannot be completed as requested on the LSR and confirmed on the FOC, solely to TCG or TCG’s end user reasons will be submitted to BellSouth as a Supplemental Order. Supplemental Orders must be submitted via the method utilized to submit the original LSR, e.g., mechanized or manual unless conditions warrant otherwise and mutually agreed to by both parties.
3.7.3.2 Upon receipt of the FOC, TCG and BellSouth agree to follow the procedures for porting numbers as outlined in Attachment 5, incorporated herein by this reference.
