Qualified Financial Contracts Clause Samples

A Qualified Financial Contracts clause defines which financial agreements between parties are recognized as 'qualified' under the contract, often for the purposes of regulatory compliance or insolvency protections. This clause typically applies to derivatives, securities lending, repurchase agreements, and similar financial instruments, specifying the types of transactions and counterparties covered. Its core function is to ensure that these contracts receive special treatment in the event of insolvency or default, thereby reducing systemic risk and providing certainty to parties engaging in complex financial transactions.
