Quantity Limitations. Effective January 1, 2015, PEF may impose quantity limits on the drugs contained in the Urology Therapeutic Category per the Catamaran Standard Non Specialty Quantity Limit List January 2014 (updated 12/19/2013). Any additions or deletions to this list shall be mutually agreed upon by the Joint Committee on Health Benefits. A three-step appeal process will be available to enrollees and their doctors to appeal the dispensing limits. An educational program developed by the Joint Committee on Health Benefits will be provided to explain the dispensing limits to enrollees.
Quantity Limitations. 1.1 The Seller shall not be liable for any Relevant Claim: (a) where the liability of the Seller for any particular claim (or the aggregate liability of the Seller for several related claims) whether relating to Pioneer Anaguid and/or Pioneer Tunisia is less than three hundred and fifty thousand US dollars (US$350,000) (such claims being “de minimis claims”) provided that once the threshold set forth in paragraph 1.1(b) of this Schedule 4 is exceeded the Seller shall not be liable for any Relevant Claim where the liability of the Seller for any particular claim (or the aggregate liability of the Seller for several related claims) is less than five hundred thousand US dollars (US$500,000) and each such claim which does not so exceed five hundred thousand US dollars (US$500,000) shall constitute a “de minimis claim” provided further that any claim which constitutes a de minimis claim shall not count or be taken into consideration when determining whether the threshold set forth in paragraph 1.1(b) of this Schedule 4 has been exceeded; and (b) where the aggregate liability of the Seller for all Relevant Claims that are not de minimis claims does not exceed a threshold amount equal to 2% of the Adjusted Bid Amount, provided that once the aggregate amount of all such claims (excluding all de minimis claims) exceeds such sum the Seller shall be liable for: (i) 50% of the threshold amount referred to in this paragraph 1.1(b) of Schedule 4 and the Seller shall pay such amount to the Buyer within twenty (20) Business Days of being notified by the Buyer that the threshold amount referred to in this paragraph 1.1(b) has been exceeded and receipt by the Seller from the Buyer of reasonable documentation evidencing that the threshold has been exceeded; and (ii) subject to the other limitations set forth in this Agreement, any excess liability over and above the threshold amount referred to in this paragraph 1.1(b) of Schedule 4. 1.2 The aggregate liability of the Seller in respect of: (a) all Relevant Claims in respect of paragraphs 1 and 2.1, and, subject to paragraph 1.2(b) below, paragraph 9(c) and 10(a), 10(b), 10(c) and 10(d) of Part I of Schedule 3 shall not in any event exceed, in the aggregate, an amount equal to the Adjusted Bid Amount; (b) all Relevant Claims in respect of the Warranties in paragraphs 9(c), 10(a), 10(b), 10(c) and 10(d) of Part I of Schedule 3 shall not in any event exceed, in the aggregate, an amount equal to the value allocated to the partic...
Quantity Limitations. Each subdivision may erect 1 Subdivision Entry Sign on or adjacent to the Right-of-Way Line for each Subdivision Entrance located on a major thoroughfare or major collector road (“Entry Road”) that intersects the County Toll Road Right-of-Way or is located on a property line of a subdivision that intersects the County Toll Road Right-of-Way. For the purposes of these Regulations, 2 Subdivision Entry Signs on either side of the Entry Road leading to the same Subdivision Entrance are considered 1 Subdivision Entry Sign. Notwithstanding the foregoing, all Subdivision Entry Signs shall be no less than 1/2 mile apart, and the total number of Visible Subdivision Entry Signs shall not exceed 5 in number per subdivision.

If the total Wastewater flows or loadings introduced at all of an Incorporating Subdivision's points of connection exceed 95% of its limitations for each month of any three consecutive months, then the Incorporating Subdivision shall, within 45 days from the end of the third consecutive month for which the flows or loadings exceeded 95% of the respective limitations, submit to the Authority a report setting forth the Incorporating Subdivision's plans for preventing the introduction by it of Wastewater in excess of the flow or loadings limitations provided for herein.
Quantity Limitations. The quantity of each Product ordered by Horizon to be supplied by AHP in accordance with such orders in any Calendar Quarter shall not be less than seventy-five percent (75%) of the quantity of such Product specified in the most recent Binding Quarterly Forecast applicable to such Calendar Quarter. Additionally, AHP shall not be obligated to supply that quantity of any Product in any Calendar Quarter that is more than one hundred twenty-five percent (125%) of the quantity of such Product specified for the most recent Binding Quarterly Forecast applicable to such Calendar Quarter, but shall use its Commercially Reasonable Efforts to meet requirements in excess of such quantity. AHP shall provide sixty (60) days' written notice to Horizon in the event AHP determines that it cannot fill an order.

  • Specific Limitations No Member shall have the right or power to: (a) withdraw or reduce such Member’s Capital Contribution except as a result of the dissolution of the Company or as otherwise provided by law or in this Agreement; (b) make voluntary Capital Contributions or to contribute any property to the Company other than cash; (c) bring an action for partition against the Company or any Company assets; (d) cause the termination and dissolution of the Company, except as set forth in this Agreement; or (e) upon the Distribution of its Capital Contribution require that property other than cash be distributed in return for its Capital Contribution. Each Member hereby irrevocably waives any such rights.

  • Warranty Limitations The Limited Warranties in clauses 1.2 and 1.3 are subject to and must be read together with the limitations, exclusions, and limitations set out below.

  • Prescription Drug Quantity Limits We limit the quantity of certain prescription drugs that you can get at one time for safety, cost-effectiveness and medical appropriateness reasons. Our clinical criteria for quantity limits are subject to our periodic review and modification. Quantity limits may restrict: • the amount of pills dispensed per thirty (30) day period; • the number of prescriptions ordered in a specified time period; or • the number of prescriptions ordered by a provider, or multiple providers. Our formulary indicates which prescription drugs have a quantity limit. Prescription drugs and diabetic equipment or supplies can be bought from the following types of pharmacies: • Retail pharmacies. These dispense prescription drugs and diabetic equipment or supplies. • Mail order pharmacies. These dispense maintenance and non-maintenance prescription drugs and diabetic equipment or supplies. • Specialty pharmacies. These dispense specialty prescription drugs, defined as such on our formulary.   • Usage Limitations You shall use best efforts to ensure that only Authorized Customer Support Users are provided access to the Service Desk Infrastructure and Student Support Services, including not causing or permitting third parties to access such infrastructure or services.

  • Warranty Limitation We do not warrant that the operation of Software will be uninterrupted or error free, or that Software will operate in hardware and Software combinations other than as expressly required by us in the Product specifications or that Software will meet your requirements.
