RECOGNITION AND DEFINITIONS. 2.01 The Employer recognizes the Ontario Nurses’ Association as the exclusive bargaining agent for all registered nurses, and nurses with Temporary Certificates of Registration, employed in a nursing capacity at the Queen’s Family Health Team at Queen’s University in Kingston, save and except nurse manager and persons above the rank of nurse manager. (a) Regular full-time is an employee who normally works a regular schedule of thirty-five (35) hours per week. (b) Regular part-time is an employee who normally works a regular schedule of less than thirty-five (35) hours per week. (c) Casual is an employee who works on an ad hoc basis, as required by the Employer, does not have an ongoing fixed schedule, and may decline casual work. (d) Temporary is an employee on a term and task basis to replace nurses on leave of absence (including pregnancy and parental leave), to fill temporary vacancies as provided under Article 11.07, or to perform work arising out of a new program which is funded for a fixed period of time. A nurse hired on this basis shall be deemed to be in the bargaining unit; however, the parties agree that such interim replacement nurse shall have no claim to the position temporarily filled. 2.03 A nurse who holds a Temporary Certificate of Registration in accordance with the Nursing Act, 1991 and its Regulations must obtain their Certificate of Registration prior to the expiry of their Temporary Certificate. If the nurse fails to obtain their Certificate of Registration prior to the expiry of their Temporary Certificate of Registration they will be deemed to be not qualified for the position of registered nurse and they will be terminated from the employ of the Employer. (a) Regular full-time A Registered Nurse is an employee a nurse who normally works a regular schedule holds certification with the College of thirty-five (35) hours per weekNurses of Ontario in accordance with the Regulated Health Professions Act and the Nursing Act.
(b) Regular part-A nurse is required to present to the Director of Nursing or designate on or before February 15th of each year evidence that her or his Certificate of Registration is in good standing and currently in effect. Such time will be extended for reasons where the College of Nurses permits the nurse’s Certificate of Registration to remain in effect. If the nurse’s Certificate of Registration is an employee who normally works a regular schedule of less than thirty-five (35) hours per week.
(c) Casual is an employee who works on an ad hoc basis, as required suspended by the EmployerCollege of Nurses of Ontario for non- payment of the annual fee, does not have an ongoing fixed schedulethe nurse will be placed on non-disciplinary suspension without pay. If the nurse presents evidence that her or his Certificate of Registration has been reinstated, and may decline casual work.
(d) Temporary is an employee on a term and task basis to replace nurses on leave of absence (including pregnancy and parental leave), to fill temporary vacancies as provided under Article 11.07, she or to perform work arising out of a new program which is funded for a fixed period of time. A nurse hired on this basis he shall be reinstated to her or his position effective upon presenting such evidence. Failure to provide evidence within 90 calendar days of the nurse being placed on non-disciplinary suspension by the Home will result in the nurse being deemed to be in no longer qualified and the bargaining unit; however, the parties agree that such interim replacement nurse shall have no claim to be terminated from the position temporarily filledemploy of the Home. Such termination shall not be subject of a grievance or arbitration.
2.03 2.3 A nurse who holds a Temporary Certificate of Registration in accordance with the Nursing Act, 1991 and its Regulations must obtain their her or his Certificate of Registration prior to the expiry of their her or his Temporary Certificate. If the nurse fails to obtain their her or his Certificate of Registration prior to the expiry of their her or his Temporary Certificate of Registration they registration, but in any case not longer than two years from her or his date of hire, she or he will be deemed to be not qualified for the position of registered nurse and they she or he will be terminated from the employ of the EmployerHome. Such termination shall not be the subject of a grievance or arbitration. A nurse who holds a Temporary Certificate of Registration will be classified, for purposes of salary, in accordance with Appendix ‘A’.
2.04 2.4 A registered Full-Time nurse is a nurse who holds a Certificate of Registration with is regularly scheduled to work the College of Nurses of Ontario normal Full- Time hours referred to in accordance with the Regulated Health Professions Act,1994 as amended and the Nursing ActArticle 12.
2.05 Nurse Practitioner - Registered Nurse Extended Class" 2.5 A Regular Part-time nurse is defined as a nurse who holds normally works less than the Full-Time hours over a fourteen (14) day schedule referred to in Article 12 and who offers to make a commitment to be available for work on a regular pre-determined basis of:
(i) Two (2) days per week
(ii) Every other weekend.
(a) A Casual Part time nurse is a nurse who works on an Extended Class Certificate of Registration occasional/relief basis and who is not pre-scheduled to work.
(b) The Employer agrees to employ sufficient Registered Nurses to meet the minimum staffing levels that may be set from time to time by statute and or regulation and by the Employers Service Agreement with the College Ministry.
2.7 The Home will maintain at least 262.5 bargaining unit RN staffing hours each week for the duration of Nurses this Collective Agreement unless the Home cannot reasonably maintain this commitment due to a decrease in Provincial funding. Recognizing the mutual objective of Ontario in accordance quality resident care, the Employer agrees to meet through the Union Management Committee with the Regulated Health Professions ▇▇▇ ▇▇▇▇ Union as amended soon as practicable after the receipt of the annual CMI/RAI MDS report. The Employer agrees to provide the Union with staffing levels, and staffing mix information; the Nursing Actimpact of related payroll costs on staffing levels and a written notice of the CMI/RAI MDS report for the facility. The purpose of this meeting is to discuss the impact of the CMI/RAI MDS report on the staffing levels in the Home, quality resident care, and provide the Union with an opportunity to make representation in that regard.
