RECOGNITION AND DEFINITIONS. 1.01 The Board recognizes the ▇▇▇▇ Classroom Teachers Association (LCTA) as the exclusive bargaining representative of the bargaining unit comprised of part-time and full-time ▇▇▇▇ County School District employees in job classifications certified on April 21, 1975, Case No. 8H-RC-744-1037 by the Florida Public Employee Relations Commission or agreed to by the parties. A listing of these bargaining unit classifications as of the date of ratification of this Contract is contained in Appendix A.
RECOGNITION AND DEFINITIONS. 2.01 The Employer recognizes the Ontario Nurses’ Association as the exclusive bargaining agent for all registered nurses, and nurses with Temporary Certificates of Registration, employed in a nursing capacity at the Queen’s Family Health Team at Queen’s University in Kingston, save and except nurse manager and persons above the rank of nurse manager. (a) Regular full-time is an employee who normally works a regular schedule of thirty-five (35) hours per week. (b) Regular part-time is an employee who normally works a regular schedule of less than thirty-five (35) hours per week. (c) Casual is an employee who works on an ad hoc basis, as required by the Employer, does not have an ongoing fixed schedule, and may decline casual work. (d) Temporary is an employee on a term and task basis to replace nurses on leave of absence (including pregnancy and parental leave), to fill temporary vacancies as provided under Article 11.07, or to perform work arising out of a new program which is funded for a fixed period of time. A nurse hired on this basis shall be deemed to be in the bargaining unit; however, the parties agree that such interim replacement nurse shall have no claim to the position temporarily filled. 2.03 A nurse who holds a Temporary Certificate of Registration in accordance with the Nursing Act, 1991 and its Regulations must obtain their Certificate of Registration prior to the expiry of their Temporary Certificate. If the nurse fails to obtain their Certificate of Registration prior to the expiry of their Temporary Certificate of Registration they will be deemed to be not qualified for the position of registered nurse and they will be terminated from the employ of the Employer. Such termination shall not be the subject of a grievance or arbitration. 2.04 A registered nurse is a nurse who holds a Certificate of Registration with the College of Nurses of Ontario in accordance with the Regulated Health Professions Act,1994 as amended and the Nursing Act. 2.05 Nurse Practitioner - Registered Nurse Extended Class" is defined as a nurse who holds an Extended Class Certificate of Registration with the College of Nurses of Ontario in accordance with the Regulated Health Professions ▇▇▇ ▇▇▇▇ as amended and the Nursing Act. 2.06 All references to spouses in this Agreement shall include common-law and same sex partners.

RECOGNITION AND DEFINITIONS. 2.1 The Employer recognizes the Association as the Bargaining Agent for all Registered and Graduate nurses engaged in a nursing capacity save and except the Administrative Coordinator, and persons above the rank of Administrative Coordinator. (a) A Registered Nurse is a nurse who holds certification with the College of Nurses of Ontario in accordance with the Regulated Health Professions Act and the Nursing Act. It will be the responsibility of the nurse to produce an up-to-date Certificate of Competence to the Nursing Office by January 1st of each year. Failure to comply will result in the reduction of pay to the Graduate Nurse level. (b) A nurse is required to present to the Director of Nursing or designate on or before February 15th of each year evidence that her or his Certificate of Registration is in good standing and currently in effect. Such time will be extended for reasons where the College of Nurses permits the nurse’s Certificate of Registration to remain in effect. If the nurse’s Certificate of Registration is suspended by the College of Nurses of Ontario for non- payment of the annual fee, the nurse will be placed on non-disciplinary suspension without pay. If the nurse presents evidence that her or his Certificate of Registration has been reinstated, she or he shall be reinstated to her or his position effective upon presenting such evidence. Failure to provide evidence within 90 calendar days of the nurse being placed on non- disciplinary suspension by the Home will result in the nurse being deemed to be no longer qualified and the nurse shall be terminated from the employ of the Home. Such termination shall not be subject of a grievance or arbitration.

The term teacher when used hereinafter in this agreement shall refer to all employees eligible for representation by the Association as specified in paragraph A above. The Board agrees not to negotiate with any teachers' organization other than the Association during the effective period of this agreement. The Board agrees not to negotiate individually with teachers in matters covered by this contract. D. The parties agree that the provisions of this agreement shall not be applied in a manner, which is arbitrary, capricious, nor discriminatory, and both parties agree to active efforts to implement the negotiation agreement in good faith. E. The Board hereby retains and reserves unto itself all powers, rights, authority, duties, and responsibilities conferred upon and invested in it by the Statutes of the State of Illinois. The legal rights inherent in the School Code and the rulings and regulations of the Illinois State Board of Education affecting personnel are in no way abridged by this agreement.
