Reference in Recovery Bonds to Supplemental Indentures Clause Samples
The "Reference in Recovery Bonds to Supplemental Indentures" clause establishes that any recovery bonds issued under an indenture will also be governed by the terms and provisions of any supplemental indentures. In practice, this means that when changes or additions are made to the original indenture through supplemental agreements, those modifications automatically apply to the recovery bonds, ensuring consistency and legal enforceability. This clause is essential for maintaining the integrity of the bond agreement over time, as it ensures that all relevant updates or amendments are incorporated and binding on all parties, thereby preventing confusion or disputes regarding which terms apply.
Reference in Recovery Bonds to Supplemental Indentures. Recovery Bonds authenticated and delivered after the execution of any supplemental indenture pursuant to this Article IX may bear a notation as to any matter provided for in such supplemental indenture. If the Issuer shall so determine, new Recovery Bonds so modified as to conform, in the opinion of the Issuer, to any such supplemental indenture may be prepared and executed by the Issuer and authenticated and delivered by the Indenture Trustee in exchange for Outstanding Recovery Bonds.
