Common use of Regular Position Clause in Contracts

Regular Position. Upon learning from the employee’s attending 3 physician that the employee should be able to assume her/his 4 regular duties, the employee will notify her/his supervisor within 5 two (2) working days. Following official notification by the 6 Employer that the employee has the right to be reinstated to 7 his/her position, the employee has seven (7) days in which to 8 request reinstatement. If the employee requests reinstatement in 9 accordance with the statute and if the employee’s position exists, 10 the employee shall be returned to it any time within three (3) 11 years from the first date of injury or illness, as defined by law. If 12 the employee’s position no longer exists, he/she will be returned 13 to an available and suitable position. The employee shall be 14 deemed to have resigned if the position is not accepted or if the 15 employee fails to report for work in a timely manner following 16 her/his acceptance.
