Requested Modifications. If a prospective mortgagee requires reasonable amendments, modifications, or supplements of or to the Mixed-Use Provisions as a condition to making a loan to Company, then the Town Bodies shall execute an agreement amending, modifying, or supplementing the Mixed-Use Provisions as required by the prospective mortgagee; provided that the foregoing shall apply only so long as: (i) there will be no material adverse effect on the Town Bodies, or the rights of the Town Bodies under the Mixed-Use Provisions; and (ii) the obligations of Company under the Agreement will not be reduced in any material respect.

Requested Modifications. The Customer hereby agrees to approve and to comply with the provisions established under Chapter 6 of the Access Code.

Requested Modifications. If, in connection with obtaining, continuing or renewing financing for which the Building, Land or the Demised Premises or any interest therein represents collateral in whole or in part, a banking, insurance or other lender shall request reasonable modifications of this Lease as a condition of such financing, Lessee will not unreasonably withhold, delay or defer its consent thereto, provided that such modifications do not increase the monetary obligations of Lessee hereunder or adversely affect to a material degree the Lessee's leasehold interest hereby created.

Requested Modifications. BSC may request or ArthroCare may suggest changes to improve the design or operation of the Products, or the reliability or serviceability of the Products. The parties shall promptly discuss such modifications in good faith and ArthroCare shall perform the engineering design work to modify the Specifications as requested by BSC, provided that BSC agrees to pay the reasonable costs of such work. If the changes require engineering design work on the Specifications, ArthroCare will prepare and submit to BSC for its approval a budget for the direct cost of making such work on a time and materials basis. The time will include the fully burdened rate for each employee involved in such work plus [*****] of the fully burdened cost to account for overhead.

Requested Modifications. Urosurge may request changes in the design or operation of the Products relating to improvements, or the reliability or serviceability of the Products. The parties shall discuss such modifications in good faith; provided, however, it is understood that ITC shall have no obligation to make such modifications to the Products.

Requested Modifications. If a prospective mortgagee requires reasonable amendments, modifications, or supplements of or to the Agreement as a condition to making a loan to Developer, then YRC shall execute an agreement amending, modifying, or supplementing the Agreement as required by the prospective mortgagee; provided that the foregoing shall apply only so long as: (i) there will be no material adverse effect on YRC, or the rights of YRC under the Agreement; and (ii) the obligations of Developer under the Agreement will not be reduced in any material respect.

Requested Modifications. Somnus may request or Apical may suggest ----------------------- changes in the design or operation of the Products relating to improvements, or the reliability or serviceability of the Products. The parties shall promptly discuss such modifications in good faith and Apical shall make any modifications requested by Somnus, provided Somnus agrees to pay the reasonable costs of implementing such changes.

Requested Modifications. The work involved in producing customer requested modifications is excluded from this agreement. The support and maintenance of such modifications are included after they have been completed and accepted.

Requested Modifications. If, in connection with obtaining, continuing or renewing financing for the Building or any interest therein represents collateral in whole or in part, a lender shall request reasonable modifications of this Lease as a condition of such financing, Tenant will not unreasonably withhold, delay or defer its consent thereto, provided that such modifications do not increase the monetary obligations of Tenant hereunder or adversely affect to a material degree the Tenant’s leasehold interest hereby created.
