Common use of Restrictions on Use of the Services Clause in Contracts

Restrictions on Use of the Services. The rights granted to you in this Agreement are subject to the following restrictions: (a) you shall not license, sell, rent, lease, transfer, assign, reproduce, distribute, host or otherwise commercially exploit Services or any portion of Services; (b) you shall not frame or utilize framing techniques to enclose any trademark, logo, or other Services (including images, text, page layout or form); (c) you shall not use any metatags or other “hidden text” using Spyce’s name or trademarks; (d) you shall not modify, translate, adapt, merge, make derivative works of, disassemble, decompile, reverse compile or reverse engineer any part of Services except to the extent the foregoing restrictions are expressly prohibited by applicable law; (e) you shall not use any manual or automated software, devices or other processes (including but not limited to spiders, robots, scrapers, crawlers, avatars, data mining tools or the like) to “scrape” or download data from the Services; (f) you shall not access Services in order to build similar or competitive products or services; (g) except as expressly stated herein, no part of Services may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means; (h) you shall not remove or destroy any copyright notices or other proprietary markings contained on or in Services; (i) you shall not circumvent, remove, alter, deactivate, degrade, or thwart any of the protections of the Services; (j) you will not take any action that imposes or may impose (in our sole determination) an unreasonable or disproportionately large load on our technical infrastructure; and (k) you will not interfere with or attempt to interrupt the proper operation of the Services through any virus, device, information collection or transmission mechanisms, software or routine, or access or attempt to gain access to any data, files, or passwords related to the Services through hacking, password or data mining, or any other means. Any future release, update or other addition to Services shall be subject to this Agreement. Spyce reserves all rights not granted in this Agreement. Any unauthorized use of Services terminates the licenses granted by Spyce pursuant to this Agreement. The foregoing sentence is not exclusive of any other rights or remedies that may be available to Spyce under law, equity, statute, or otherwise.

Restrictions on Use of the Services. The SanKash reserves all rights in the Services not granted in these Terms of Service. Without limiting the foregoing, by using the Services You agree not to: Use the Service for any purpose other than for using the features SanKash intentionally provides or makes available to you in this Agreement are subject You; share Your password, allow any person to access Your account, or take any action or inaction that might jeopardize the following restrictions: (a) you shall not security of Your account; assign or transfer Your account or login information to anyone; attempt to access the accounts of any user of the Service other than Your own account; translate, modify or create derivative works of the Services; upload, download, recreate, display, perform, post, reproduce or copy the Services, except with the prior written consent of ▇▇▇▇▇▇▇; attempt to derive the source code, source files or structure of the software contained in the Services by reverse engineering, disassembly, decompilation or any other means; use the Services except in accordance with all applicable law; introduce into the Services any “malware,” such as, but not limited to, viruses, worms, and Trojan Horses; use deep-links, page or screen scrapes, web crawlers, web robots, spiders, wanderers, web scutters, or programs, algorithms or methodologies which do the same things in connection with the Services, or use other automated processes to access or to use the Services; (b) you shall not frame provide false personal information or utilize framing techniques create an account for anyone other than Yourself without ▇▇▇▇▇▇▇’s permission; create another account without ▇▇▇▇▇▇▇’s permission, if SanKash had disabled Your account; post, transmit or link from any unlawful, infringing, misleading, deceptive, threatening, libelous, defamatory, plagiarized, fraudulent, harassing, obscene, discriminatory, inflammatory, pornographic or profane material, spam or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to enclose civil liability, or would otherwise violate applicable law; use the Services in any manner that could damage, disable, undermine, overburden or impair the Services or the servers on which it runs or interfere with any other party’s use of the Services; upload, download, post, email or otherwise transmit any material that may infringe copyright, patent, trademark, logotrade secret, or other Services (including imagesintellectual property or proprietary rights of any party; obtain or attempt to obtain any content through any means not intentionally made available or provided for through the Services; harm minors in any way; threaten the unity, textintegrity, page layout defence, security or form)sovereignty of any State, friendly relations between foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation; (c) you shall not use share any metatags information that is harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another’s privacy, hateful, or other “hidden text” using Spyce’s name racially, ethnically objectionable, disparaging, relating to or trademarksencouraging money laundering or gambling, or otherwise harmful in any manner whatsoever; (d) you shall not modifyintentionally submitting on the Platform, translate, adapt, merge, make derivative works of, disassemblefalse or inaccurate information; attempt to decipher, decompile, reverse compile disassemble or reverse engineer any part of Services except the SanKash Internet based applications, or attempting to create any derivate works of the extent the foregoing restrictions are expressly prohibited by applicable lawSanKash Internet based applications; (e) you shall not use any manual forging headers or automated software, devices or other processes (including but not limited to spiders, robots, scrapers, crawlers, avatars, data mining tools or the like) to “scrape” or download data from the Services; (f) you shall not access Services otherwise manipulating identifiers in order to build similar disguise the origin of any message, transmittal You send through the SanKash Internet based applications, or competitive products or services; (g) except as expressly stated herein, no part of any Services may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means; (h) you shall not remove or destroy any copyright notices or other proprietary markings contained offered on or in Servicesthrough the SanKash Internet based applications; (i) you shall not circumvent, remove, alter, deactivate, degrade, or thwart use any of the protections logos, trademarks, service marks or other indicators of origin appearing on the Services; (j) you . SanKash will fully cooperate with any law enforcement authorities or court order requesting or directing SanKash to disclose the identity of anyone violating these Terms of Service. SanKash believes in children’s online safety and does not take wish to receive information regarding children under 18 years old. Therefore, You may not post or submit any action that imposes personally identifiable information of a child under 18 years old or may impose (in our sole determination) an unreasonable information sufficient to locate such a child on or disproportionately large load on our technical infrastructure; and (k) you will through the Service.
