Common use of Retraining and Study Leave Clause in Contracts

Retraining and Study Leave. 9.16.1 An unpaid leave of absence for study/retraining may be granted to any full-time member of the bargaining unit. 9.16.2 Such leave of absence may be taken in separate six (6) month periods or in any other appropriate periods rather than for a continuous one (1) year period provided the separate periods of leave of absence shall be commenced and completed within a three (3) year period. Any period of service by the individual intervening between the authorized separate periods shall comprise a part of the service required for a subsequent leave of absence for study or retraining purposes. 9.16.3 Study/retraining leave cannot be granted to an individual who has not served at least three (3) consecutive years preceding granting of the leave. 9.16.4 No more than one study/retraining leave of absence for a unit member shall be granted in each three (3) year period. 9.16.5 The District may prescribe standards of service which shall entitle the unit member to the leave of absence. 9.16.6 Unit members granted an unpaid leave for up to six (6) months will be guaranteed reinstatement and may be replaced with a temporary or substitute employee. At least two (2) weeks prior to returning to the District, the unit member on leave shall verify to the Director of Human Resources of their intent to return or not return to the District at the end of the approved leave. Failure to provide notice of intent to return to employment shall result in their automatic resignation. Unit members who are on an approved leave for greater than six (6) months shall not be guaranteed reinstatement by the District but will be placed on the District’s thirty-nine (39) month rehire list. Priority to reinstatement shall only occur after laid off unit members’ rehire rights and other unit members who have reemployment rights.

To be eligible for a study or 19 retraining leave, the member must agree to render at least two years of service in the 20 employ of the Board of Education after returning from the leave. 9.16.3 Study/21 8.14.4 A member who has received a study or retraining leave canshall not be granted considered to an individual who has 22 be eligible for further leave under this Section. 1 8.14.5 To apply for a study or retraining leave, the member must submit a total study or 2 retraining plan including name of education or training institutions, proof of acceptance 3 into the program, a detailed description of the program, a detailed description of the 5 direct use of the skills, knowledge, and abilities in future service to the District, a 6 suggested leave time-line, and the number of hours of required attendance in the 7 program. The application must be submitted to the Superintendent not served at least later than three (3) consecutive years preceding granting 8 months prior to the proposed beginning date of the leave. 9.16.4 No more than one study/9 8.14.6 Members granted a study or retraining leave of absence for a unit member shall be granted required to perform such 10 services during the leave as the Board of Education and the member agree to in each three (3) year periodwriting. 9.16.5 The District may prescribe standards 11 8.14.7 A member on a District-approved study or retraining leave shall receive the 12 difference between the salary of service which the member on leave and the salary of a substitute in the 13 position previously held by the member on leave.
