Common use of Return to Work from Leave of Absence Clause in Contracts

Return to Work from Leave of Absence. An employee returning to work after a leave of absence shall notify the Board of the employee’s intent to return and provide a medical release as soon as the medical release is available. An employee returning to work from a leave of absence for personal illness or medical disability shall submit a physician’s statement indicating the employee’s ability to return to work and perform employee’s essential job duties (with or without restrictions). Any employee who, consistent with the Board’s reasonable time requirements, fails to request an extension of the leave of absence or fails to return to work, or fails to provide the required physician’s statement, shall be deemed to have resigned and the employee’s employment with the school district shall be terminated. Any employee who, consistent with the Board’s reasonable time requirements, fails to request an extension of the leave of absence or fails to return to work, or fails to provide the required physician’s statement, shall be deemed to have resigned and the employee’s employment with the school district shall be terminated. The employee’s right to return to work shall be subject to the following:following and also subject to the provisions of the “Layoff” article. Any employee who fails to return to work, or to provide the notices required herein, shall be deemed to have resigned and to have terminated employment with the school district, unless an extension of the leave of absence has been granted.
