Right to Refuse to Work. Subject to all provisions of the Northwest Territories Safety Act R.S.N.W.T. 1988 c.s-1, as amended and to the Safety Regulations prescribed under the Safety Act as amended: (a) employees may refuse to do any work where they have reason to believe that: (i) there exists an unusual danger to their health and safety; (ii) the carrying out of the work is likely to cause to exist an unusual danger to their health or safety or that of any other person; or (iii) the operation of any tool, appliance, machine, device or thing is likely to cause to exist an unusual danger to their health or safety or that of any other person. (b) ‘unusual danger’ means, in relation to any condition: (i) a danger that does not normally exist in that occupation; or (ii) a danger under which persons engaged in that occupation would not normally carry out their work. (c) No loss of wages or discriminatory action shall be taken against employees by reason of the fact that they exercised the right conferred upon them in subsection (a). (d) No other employee shall be required to use or operate any machine, device, material or thing or perform any part of the work which is being investigated pending resolution of the situation.
Right to Refuse to Work with Non-Union Employees Refusal on the part of Union members to work with non-Union employees, pertaining to the bargaining unit, shall not be deemed a breach of this Agreement. In such cases, the Employer involved will be given prior notice.
Right to Refuse to Work. An employee may refuse to work in accordance with the provisions of the Occupational Health and Safety Act where the worker has reason to believe that: (a) Any equipment, machine, device or thing the worker is to use or operate is likely to endanger himself, herself or another worker. (b) The physical condition of the workplace or part thereof in which he or she works or is to work is likely to endanger himself or herself; or see any equipment, machine, device or thing he or she is to use or operate or the physical condition of the workplace or the part thereof in which he or she works or is to work is in contravention of this Act or the regulations and such contravention is likely to endanger himself, herself or another worker. All rights and responsibilities of the employee in connection with such qualifying work refusals must be complied with in accordance with Part V of the Occupational Health and Safety Act.

  • Right to Refuse Employees have the right to refuse to undergo drug and alcohol testing. If an employee refuses to undergo drug or alcohol testing requested or required by the Employer, no such test shall be given.

  • Right to Refuse Unsafe Work Employees have the right to refuse to perform unsafe work pursuant to the Occupational Health and Safety Regulations of the Workers Compensation Act.

  • Right to Refuse Overtime All employees shall have the right to refuse to work overtime, except when required to do so in emergency situations, without being subject to disciplinary action for so refusing.

  • Right to Reject Notwithstanding Buyer’s rights pursuant to Sec. 8.5 and save other rights pursuant to this Order, Buyer may reject any goods within 2 months from the delivery if they are materially defective and in Buyer’s reasonable assessment do not allow a commercially reasonable use. In that case, no payments for these goods are due.

  • Right to Refuse to Cross Picket Lines (a) All employees covered by this Agreement shall have the right to refuse to cross a picket line arising out of a dispute as defined in the appropriate legislation. Any employees failing to report for duty shall be considered to be absent without pay. (b) Failure to cross a picket line encountered in carrying out the Employer's business shall not be considered a violation of this Agreement nor shall it be grounds for disciplinary action.
