Common use of SCOPE CHANGES Clause in Contracts

SCOPE CHANGES. Owner, without invalidating this Agreement, may order Scope Changes to the Services, in which event one or more of the Contract Price, the Construction Progress Milestone Dates, the Guaranteed Completion Dates, the Payment and Milestone Schedule, the Project Schedule and the Performance Guarantees shall be adjusted accordingly, if necessary. All Scope Changes shall be authorized by a Scope Change Order and only the Owner or the Owner's Representative may issue Scope Change Orders. Notwithstanding the above, Contractor shall not be required to perform a Scope Change which is impossible to comply with as a practical matter or which will have a material adverse effect on the technical soundness, or the full, safe and reliable operation of the Facility in accordance with Applicable Laws, Applicable Permits and Prudent Utility Practices.
