Common use of Section 9.5.3 Clause in Contracts

Section 9.5.3. 18 The most senior employee in layoff status shall receive preferential consideration regarding 19 recall from layoff to an open position when skill, ability or qualifications are substantially equal 20 to a less senior employee in layoff status. Employees recalled from layoff shall begin, effective 21 with the first day of work in the new assignment, a secondary probationary period of sixty (60) 22 calendar days duration. During the secondary probationary period, the retention of the 23 employee in the newly assigned position shall be solely and entirely at the discretion of the 24 District. If the District determines that the employee is unsuccessful or is likely to be 25 unsuccessful in the assigned position, the employee may be returned to the layoff pool for a 26 possible later assignment according to provisions of this Article.
