Self Scheduling. Owner is expected to offer each RMR Generator into the NYISO’s Energy and Ancillary Service markets using the ISO-committed flexible bid mode at its Reference Levels for economic scheduling. However, Owner may request permission to self-schedule an RMR Generator for operational and maintenance considerations, including required testing or for fuel management purposes. The ISO may accept or reject the requested self-schedule in its sole discretion. Variable Costs during ISO-approved self schedules will be the self-scheduled RMR Generator’s Reference Levels.

(c) The Employer will schedule at least forty-eight (48) hours off following night duty when changing to another tour. Except where the employee(s) agrees to such short change, premium pay shall be paid for the first tour worked as the result of the short change. It is understood that this premium for short change will not apply to shifts added after the schedule has been posted if the employee(s) have agree to such change. It is also understood that part-time employees may make themselves available for additional shifts, beyond their normal rotation prior to the schedule being posted. Such availability will not trigger this premium pay.

(a) There shall be a minimum of sixteen (16) hours off between changes of tour unless mutually agreed otherwise provided that this would not apply to extended tours or daylight savings changeover.
(b) At least forty-eight (48) hours off are to be scheduled following consecutive night shifts when changing to days or evenings, unless mutually agreed otherwise.
Self Scheduling. The Association and the Hospital agree in principle to the concept of self- scheduling. Self-scheduling is the collective responsibility of the nurses involved to ensure the proper coverage of the unit and to ensure that all provisions of the Collective Agreement are respected at all times. Should the Hospital or the nurses wish to implement self-scheduling on a particular unit, the nurses shall do so in writing to the Employer and the Association. The Employer shall do so in writing to the Association.
(a) The secret ballot vote will be conducted solely by the Association and the Association will inform the Hospital of the result of the vote. When eighty percent (80%) of the employees on a unit indicate their willingness to participate in self-scheduling, the Association and the Employer will meet forthwith to make arrangements to implement self-scheduling.
(b) Self-scheduling may be cancelled by either the Hospital or the Association upon a minimum of eight (8) weeks written notice to the other party. The nurses will indicate by a seventy percent (70%) vote by secret ballot their desire to discontinue self-scheduling. The Collective Agreement shall apply in all respects. Violation of the Collective Agreement will not be permitted.
i) The Hospital and the Union will develop guidelines and the Immediate Supervisor will modify them with the nurses to meet the operational needs. A copy will be provided to the Bargaining Unit President.
ii) Nurses participating in self-scheduling will be responsible to develop a Master Rotation. They will also be responsible for the preparation of each schedule by indicating their tours of duty, statutory holidays, and lieu days in accordance with the unit’s self-scheduling guidelines.
iii) The Immediate Supervisor will review the schedule to ensure that the needs of the unit are met and the Collective Agreement is respected. In cases where discrepancies occur, the schedule will be returned to the facilitator for correction. It is understood that a schedule which contravenes the scheduling guidelines or the Collective Agreement will not be posted and the Master Rotation will be in effect.
