SENIORITY AND RECALL. 21.01 Seniority is defined as the length of continuous service with the Midland Police Service, and for the purpose of this Article shall be applied in determining the order of recall of members. 21.02 Seniority shall be effective from the date employment commences with the Midland Police Service. 21.03 The BOARD shall maintain an up-to-date list, showing the date upon which each member’s service commenced. A copy of the Seniority List shall be made available to the ASSOCIATION upon request. 21.04 Seniority rights shall cease in the following circumstances: a) if a member resigns; b) if a member is discharged under the Police Act and not reinstated; c) if a member retires; d) if a member is laid off for a period in excess of five (5) years; e) if a member who has been laid off does not report for work within fourteen (14) days of recall, as provided for in Article 21.06. 21.05 Where the BOARD has made a decision to reduce the complement of the Police Service and such reduction of personnel cannot be accommodated through attrition, and where such action is not in contravention of the Police Services Act of Ontario, the members shall be laid off in order of reverse seniority and shall be recalled in order of seniority when a vacancy in the compliment of the Service exists. 21.06 Members laid off due to a reduction in staff and who fail to return to work within fourteen (14) working days after notice to return to work has been forwarded by registered mail to the last known address of such member shall be deemed to have severed their service with the BOARD and shall forfeit all seniority rights, except in the case of sickness or other just cause. 21.07 No new members will be hired until those laid off members have been given the opportunity of recall. 21.08 A member who is laid off by the BOARD shall have the option to have their benefit coverage continue for a period of twenty-four (24) months from the date of layoff provided he/she reimburses the BOARD as required to cover costs.

18.09 The BOARD agrees that, in the event that the members of the Association are displaced from their positions with the Midland Police Service as a result of the disbandment of the Midland Police Service due to a voluntary amalgamation, legislative restructuring or regionalization, contract policing with another Police Service, contract policing with the Ontario Provincial Police or other form of Policing as may be permitted by law, and not offered the same or comparable employment with the new service, the BOARD shall, at the time of such displacement, provide the members with a severance package consisting of Salary at the rate of three (3) weeks salary per year of service to a maximum salary of twenty-four (24) months.
10.10 If the members are provided employment with the new service, and the new Police Service has a pension plan other than the Ontario Municipal Employees Retirement System (OMERS), the Board will be responsible for the costs associated to the transfer of the members years of accredited service from the Ontario Municipal Employees Retirement System (OMERS) to an equivalent number of accredited years of service in the new pension plan.

18.10 If the members are provided employment with the new service, and the new Police Service has a pension plan other than the Ontario Municipal Employees Retirement System (OMERS), the BOARD will be responsible for the costs associated to the transfer of the members years of accredited service from the Ontario Municipal Employees Retirement System (OMERS), to an equivalent number of accredited years of service in the new pension plan.
