The 'Seniority Lost' clause defines the circumstances under which an individual or entity forfeits their previously accrued seniority status within an organization or agreement. Typically, this clause applies when an employee resigns and is later rehired, or when there is a break in service that exceeds a specified duration, resulting in the loss of benefits or privileges tied to seniority, such as vacation accrual rates or promotion eligibility. Its core function is to ensure fairness and consistency in the application of seniority-based rights, preventing individuals from retaining advantages after significant interruptions in their service.
Seniority Lost. Seniority will be lost and the employee’s name will be removed from the seniority list when an employee:
(a) voluntarily terminates their employment;
(b) is discharged for just and reasonable cause;
(c) is on layoff more than nine (9) consecutive months or until the completion of hotel renovations, whichever is longer;
(d) does not return to work on the date specified following an approved leave of absence.
Seniority Lost. Seniority will be lost when an employee:
i) receives severance pay in accordance with this agreement under Article 18.09
ii) voluntarily terminates their employment iii) is discharged for just and reasonable cause
Seniority Lost. Seniority shall be lost by an Employee upon termination, resignation or retirement.
Seniority Lost. The seniority rights of an employee shall be lost for the following reasons:
a. Resignation;
b. Termination for any reason;
Seniority Lost. Seniority shall be lost by a bargaining unit member upon termination for just cause, resignation, retirement or transfer to a non-bargaining unit position.
Seniority Lost. All seniority is lost when employment is severed by resignation, retirement or discharge for cause. Seniority is retained if severance of employment is due to layoff. In cases of layoff, teachers so affected shall retain all seniority accumulated as of the effective date of layoff.
Seniority Lost. An Employee shall lose his/her seniority and deemed to be terminated when he/she:
a) voluntarily resigns and five (5) working days have elapsed from the date of the resignation; or
b) is discharged and not reinstated;
c) is off the payroll for a continuous period of more than twelve (12) months as a result of a lay-off; or,
d) is recalled to work from lay-off and fails to report on the designated date; or
e) is absent from work without authorization for a period in excess of five (5) working days, without having provided a reason acceptable to the City. Should the employee wish to offer a reason / explanation, such must be provided in writing to the City, copy to the Union, within ten (10) calendar days of the unauthorized leave having commenced.
Seniority Lost. Seniority will be lost by: (a) resignation; (b) discharge for just cause; (c) failure to return from an approved leave of absence as scheduled without previous notification to the employee's Department Head except for reasons beyond control of the employee.
Seniority Lost. Seniority shall be lost by a bargaining unit member upon termination for cause, resignation, retirement, or when recall rights are exhausted. Upon voluntary transfer to a non-bargaining unit position, bargaining unit seniority shall neither accrue nor be lost while the employee is in such a position. Should the member not return to the bargaining unit within thirty (30) working days of voluntary transfer, the member shall forfeit all bargaining unit seniority and will have no claim to return to the unit. Such seniority may not be used to re-enter the bargaining unit during a layoff, if it would result in the layoff of a currently employed bargaining unit member. However, the employee can use his/her accumulated seniority to apply for an open position and return to the bargaining unit, or accept a position in a non-bargaining unit position while on layoff from a bargaining unit position and shall continue to accrue seniority in the bargaining unit.
Seniority Lost. Seniority shall be lost by a bargaining unit member upon termination for cause, resignation, retirement or transfer to a non-bargaining unit position. Should a bargaining unit member transfer to a non- bargaining unit position their seniority shall be frozen up to a maximum of one (1) year, and upon their return to a vacant bargaining unit position for which they are qualified, they shall begin accumulating seniority. Transferring to a non-bargaining unit position beyond one (1) year, and upon returning to vacant position for which they are qualified, shall lose all seniority thereafter.
