Seniority Portability Clause Samples

Seniority Portability. (a) Subject to paragraph (b), in the event that an employee changes Employers, seniority rights and seniority time which an employee acquires in the employment of one Employer are not portable and are not credited to the employee by another Employer. (b) Where Companies bound by this Agreement are wholly owned subsidiaries of the same Parent Company, an employee who transfers from one such Company to another shall retain his seniority for the purpose of annual vacation time and pay entitlements.
Seniority Portability. (a) The employee’s anniversary date will be the basis upon which length of service and annual vacation time is calculated. (b) Employees who are assigned to work in a lower classification will continue to be paid the wages applicable to their regular classification.
Seniority Portability. When an employee is transferred into the bargaining unit from another CenturyLink location, bargaining unit seniority will be applied in the following fashion: A. Employees entering the bargaining unit from another AFL-CIO unit that offers reciprocal seniority recognition will have their bargaining unit seniority bridged at 100% immediately. B. Non-exempt employees entering the bargaining unit from another AFL-CIO unit that does not offer reciprocal seniority recognition or a non-bargaining unit will have their latest date of hire bridged at 50% two years from the date they entered the bargaining unit. C. Employees entering the bargaining unit from another CWA unit will have immediate seniority portability. This language does not apply to management and/or non- bargaining employees. D. Exempt employees will be eligible for their union time two years from the date they return to the bargaining unit, time will be bridged for union seniority purposes only.

  • Health Insurance Portability and Accountability Act Grantee certifies that it is in compliance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA), Public Law ▇▇. ▇▇▇-▇▇▇, ▇▇ ▇▇▇ Parts 160, 162 and 164, and the Social Security Act, 42 USC 1320d-2 through 1320d-7, in that it may not use or disclose protected health information other than as permitted or required by law and agrees to use appropriate safeguards to prevent use or disclosure of the protected health information. Grantee shall maintain, for a minimum of six (6) years, all protected health information.

  • Seniority Roster The District shall maintain an updated seniority roster, indicating employee's class seniority and hire date seniority. Such rosters shall be available to CSEA.

  • Portability (a) Employees are able to maintain their participation in the scheme should they transfer their employment between Catholic schools or to the Catholic Education Office. (b) The employee is obliged to notify the principal prior to appointment of their participation in the Deferred Salary Scheme and the date that leave is due to be taken. (c) Participation in the Deferred Salary Scheme shall not impede an application for employment in a Catholic school.

  • Seniority Rosters The Employer agrees to furnish the Union each January 31 and July 31 with rosters of all employees who accrue seniority, their current and prior classifications, and start date in each classification and University start date per Section 1. Employees who have accepted positions outside the bargaining unit do not accrue class seniority in the bargaining unit when employed in positions outside the bargaining unit, but retain prior seniority earned in the bargaining unit. When two (2) or more employees have the same classification seniority date, ties shall be broken by recognizing the employee with the greater University seniority first. If a tie still continues, the employee's seniority position shall be determined by lot.
