1. ASSESSMENT Reading/Language Arts The ▇▇▇▇▇▇▇▇-▇▇▇▇▇▇▇ III Test of Cognitive Abilities (WJIII-COG) and The ▇▇▇▇▇▇▇▇-▇▇▇▇▇▇▇ III Test of Achievement (WJIII-ACH) are used as the pre- and post-assessment tool. The specific tests used in the reading assessment include auditory working memory (COG- 9), reading fluency (ACH-2), passage comprehension (ACH-9), word attack (ACH-13), reading vocabulary (ACH-17), and sound awareness (ACH-21). The subtests used are constantly being evaluated to ensure that appropriate skills are being measured by age and grade level. Additional subtests may be added or removed for the 2012-2013 academic year depending on district and state goals. Students will be assessed on an individual basis. Service Delivery Plan. In addition to reporting requirements referenced in Paragraph 38 of this Agreement, CONTRACTOR shall establish and abide by procedures, approved by ADMINISTRATOR, to document service activities performed by C ONTRACTOR’s staff for services described in Subparagraphs 3.3 through 3.10 of this Exhibit.

Tutoring materials must be high quality, research-based, and specifically designed to increase the academic achievement of eligible students and help students attain proficiency in meeting academic achievement standards of the State of Florida. Such services or other benefits, including materials and equipment, shall be secular, neutral and non-ideological. Kindergarten – 12th grade approved students will receive 30 – 60 minutes of one on one sessions of extended instruction once/twice per week for 18 – 24 sessions. These services shall also be provided in a timely manner, in comparison to services and benefits provided for public school children.
Service Delivery Plan. At least twenty (20) Business Days prior to the Programmed Section 1 Completion Date the Contractor shall provide to the Council a Service Delivery Plan in the Agreed Form. The Contractor may from time to time amend the Service Delivery Plan and shall provide to the Council five (5) copies of such amended Service Delivery Plan at least twenty (20) Business Days before the introduction of such amendment. The Council shall be entitled to comment on where, in its view (acting reasonably), the Service Delivery Plan (or any amendment) will or will not meet the Service Specification or would hinder the Council in the discharge by the Council of its obligations under the Education Acts. The Contractor shall give proper consideration to the comments made by the Council and shall amend the Service Delivery Plan to the extent the Contractor deems necessary or appropriate to ensure that the Service Specification is met and/or to ensure that the Services are delivered in a manner which will not wilfully hinder the discharge by the Council of its obligations under the Education Acts.
Service Delivery Plan. 7.1 The District Council shall itself and shall procure that a contractor on its behalf undertakes the Three-Stream Collection Service in accordance with the Service Delivery Plan.
7.2 The Service Delivery Plan shall include the proposed number of dwellings that will receive a Three Stream Collection Service for the First Financial Year calculated by using data provided by the District Council. The Service Delivery Plan shall include the day of collection and the relevant stream of Household Waste to be collected, together with such additional information as the County Council may reasonably require.
7.3 By not later than the 30th September prior to the commencement of each subsequent Financial Year:-
7.3.1 the District Council shall submit to the County Council a written report setting out:-
7.3.1.1 the proposed number of dwellings (based on BVPI 86 in April) which will receive a Three Stream Collection Service for the relevant Financial Year, and
7.3.1.2 (at the option of the District Council) any issues that the District Council wishes to discuss with the County Council with respect to the Service Delivery Plan generally, including any proposed amendment, variation or addition to the current Service Delivery Plan.
7.3.2 the County Council may submit to the District Council a written report setting out any issues that the County Council wishes to discuss with the District Council with respect to the Service Delivery Plan generally including any proposed amendment, variation or addition to the current Service Delivery Plan.
7.4 By no later than the 31st October prior to the commencement of each subsequent Financial Year: -
7.4.1 the County Council shall confirm in writing to the District Council its approval to the proposed number of dwellings that will receive a Three Stream Collection Service for that Financial Year. The County Council shall only be entitled to withhold its approval where the District Council proposes that less than 90% of the dwellings within its administrative area will receive a Three Stream Collection Service for that Financial Year and in such circumstances the provisions of Clause 6.7 are not satisfied; and
7.4.2 the parties shall meet to discuss in good faith, fairly and reasonably any issues raised by the District Council pursuant to Clause 7.3.1.2 and any issues raised by the County Council pursuant to Clause 7.3.2.
