Common use of Service Provider Network Clause in Contracts

Service Provider Network. Jutvision will implement the Service ------------------------ Provider Network in each of the following Core Service Areas by March 15, 1999: 30 miles by road east and west of Highway I-5 from the Canadian border to Olympia including Kitsap Pennisula, Spokane within a 30 mile radius, Portland, and Vancouver (WA) within a 30 mile radius. By April 19, 1999, Jutvision will implement the Service Provider Network in the remaining Core Service Areas and will provide service (as defined in Section 2.2(b)) to cities outside the Core Service Areas. Jutvision will continue discussions with Windermere to develop an appropriate solution for Whistler BC by April 30, 1999. Notwithstanding Section 2.3, in the event Jutvision fails to implement the Service Provider Network in the Territory in accordance with the schedule set forth above, Company may provide, or may enter into agreements with third parties to provide, services comparable to the Production Services until such time as Jutvision expands the Service Provider Network into such areas. Upon Jutvision's implementation of the Service Provider Network in such area, Company shall commence using Jutvision's Production Services as soon as practicable.
