Shall a. Have maximum legal discretionary authority to construe and interpret the terms and provisions of the Plan. b. Make determinations regarding eligibility for benefits, decide disputes relative to a Plan Participants rights, and decide questions of Plan interpretations and those of fact relating to the Plan. c. Have authority to remedy ambiguities, inconsistencies or omissions. d. Delegate to any person or entity such powers, duties and responsibilities it deems appropriate.

Shall. A mandate; a required action. See “must.”

Shall. Shall and will are used interchangeably meaning an obligation to perform.

Shall. For purposes of this Agreement, the words “will” and “shall” have the same meaning.

Shall. An imperative command; has a duty to or is required to. Denotes that a regulation must be followed unless the contracting officer has obtained a deviation.

Shall. 1. Ensure that students who participate in a semester at the CMC continue to be fully enrolled undergraduates of during the time of their off-campus study. 2. Screen applicants and request that students complete CMCs online application available at ▇▇▇.▇▇▇▇▇▇▇▇▇▇▇▇.▇▇▇. Applications must be completed by published deadlines. 3. Sign the CMCs Certification Form per applied student prior to said student being accepted. 4. Enjoy the same opportunities as other affiliated institutions to participate in site visits, and other mutually beneficial activities as such opportunities arise. 5. Be responsible for the payment of all fees and charges imposed by the CMC as published in the CMC’s cost sheet document on or before the billing due date. 6. Be responsible for billing students directly and determining the appropriate fee structure (including financial aid awards) and withdrawal policies. 7. Be responsible (as a Title IV Eligible Institution) for determining eligibility and disbursement of financial aid. 8. Be responsible for processing CMC’s course credits as provided through a Greenville University transcript.

Shall. When used in this Plan, the word “shall” connotes a mandatory obligation, and is not directory in nature. This amended and restated Plan has been adopted on this 3rd day of July, 2017 by the Common Council of the City of Middletown. This Appendix A lists the provisions applicable to Eligible Employees of the City who are defined, executive non-bargaining employees and defined, non-bargaining employees as determined under the Personnel Rules. In the event that the provisions of this Appendix A are inconsistent with the terms contained in the remainder of the Plan, the provisions contained in this Appendix A shall take precedence. In the event the provisions of this Appendix A are inconsistent with the terms of the Personnel Rules, the Personnel Rules shall control.

Shall. Shall is used to specify an obligation of either County or Provider and denotes a mandatory function or direction.
