Provided there is no disruption of services, employees within the same classification may agree, solely at their option and with the approval of their supervisor to trade their regularly scheduled daily shifts (or any portion thereof), subject to the provisions outlined below. 1. Trades are restricted to personnel within the same classification. Corrections Officers can only trade with Corrections Officers and Sergeants can only trade with Sergeants. 2. Trades are restricted to personnel who have current, equivalent training certifications. 3. Employees on light duty restrictions are ineligible for shift trades for full-duty positions from which their doctors have restricted them. Any pending trades for full-duty positions from which the employee has been restricted will be voided. The supervisor will notify the employees of the voided trades. 4. In order to be eligible for shift trades, an employee must not have used more than (8) sick days during the previous fiscal year. If an employee exceeds (8) sick days in one fiscal year, they will be ineligible from shift trades the remainder of the fiscal year or 180 calendar days (whichever is greater). However, any shift trades that have already been approved will remain in effect. 5. Shift trades must be within 45 days of each other and shall be limited to the regularly scheduled daily shifts the involved personnel are required to work. 6. Shift Assignment. The Sheriff shall maintain Employer may designate three (3) nonbiddable Customer Service Representative positions for special and ongoing assignments. The three (3) nonbiddable positions are Lead Customer Service Representative, Customer Service Representative/Passenger Ticket Sales, and Customer Service Representative Vault Room/Miscellaneous. The selection process for the sole right nonbiddable positions will be determined through an application process with criteria determined by the employer. Lead Customer Service Representative and Customer Service Representative/Vault Room cannot take a vacation at the same time. The nonbiddable positions will be filled by Customer Service Representatives from the bargaining unit. The selections will not be subject to assign the grievance procedure. Shift times will be designated by the Employer. The following provisions apply to the Customer Service Representatives. a. Split shifts may be scheduled by the Employer. Shift Assignment. 11.01 The Sheriff shall maintain Company and the Union agree to the principle that shift/site preference consideration for available jobs in an overtime group should be given to the senior qualified employee in each classification in the overtime group when practical. a. It is recognized that it is impossible to operate a facility efficiently with senior employees in a particular classification, in any one work center, shift, and/or location, and that seniority cannot be the sole right determining factor in shift assignments. Shift Assignment. The Sheriff shall maintain the sole right to assign employees to each shift based on operational needs. Employees assigned to continuous operations a department or division/section thereof where two or more shifts are worked, shall be placed assigned to one of the shifts by the following procedures: A. Shift assignments shall be bid on permanent shifts with a seniority basis on a minimum of once per year. B. Shift seniority shall be the length of service in a class within the department or division/section thereof. If departments or divisions/sections thereof are combined, seniority shall be integrated. C. An employee may be transferred to another shift on a temporary basis for a period not to exceed sixty (60) calendar days off rotating every twenty-eight days according per year for training purposes or other verifiable department needs. D. Probationary employees may be assigned to any shift for training purposes, but it is understood that as much training as possible be done on the shift this employee will ultimately fill. E. The Department Head may involuntarily transfer an employee to another shift within the same division, but such transfer shall be for just cause only, subject to the scheduling systems included grievance procedure. F. No change in Appendix B. Based on their classification seniorityan employee's shift may be made by the City, employees will bid except due to a verifiable emergency, unless the employee is given notice in advance of seventy two (72) hours. If less than 72 hours notice is given, the employee shall be entitled to time and one-half for shift assignment and initial days off. The divisional supervisor outside the bargaining unit or his designee shall conduct the shift bid process.
