This list must be submitted ten (10) weeks prior to the first day of the term being scheduled. Tentative schedules will be reassigned posted 60 days prior to the beginning of the term.
6. An eligible Officer may opt out of making a different selection and become subject to the normal shift other than assignment procedure. The Union may then go to the next eligible Officer to allow for filling of all of the available positions.
7. If all of the available positions are not selected, those remaining will be filled through the existing shift awarded assignment procedure.
8. An eligible Officer who does select a shift may not then arrange a shift trade. Shift Selection. Employee assignments within Effective March 1, 2010, the Patrol Bureau will occur between approximately April 1-15 Department may deploy a Day Cover Shift in Patrol. Said shift may consist of 14 officers for 2010, and shall be awarded assigned to the Day Shift Commander and supervisors. The Department shall post for volunteers for 14 days, after which time the Department may assign personnel via inverse department seniority or utilize the four (4) year provision of this Article to fill the assignments. If the Department determines to deploy a Day Cover Shift for 2011, said shift shall be included in the annual shift bidding process. All employees assigned to the shift shall work a 10 hour shift with the starting time of 0900 hrs and ending time of 1900 hrs and shall receive a $.40 shift differential for hours worked on that shift. A minimum of one Day Cover Shift employee shall be allowed on vacation at any given time. The Department may alter the start time of the Day Cover Shift by up to two (2) hours by giving notice to the Union not later than September 15. The Department shall not adjust the start times of any other patrol shifts for the balance of this CBA term absent agreement of the Union. The parties shall meet to discuss shift scheduling and call volume on an annual basis to promote efficiency in the operations of the Department.

The Chief of Police or his designee may deny the voluntary request which shall not be subject to the grievance procedure. Employees assigned to a different district shall be placed in the department.

The Public Safety Director shall have the right to deny the selected shift of any command officer provided that he/she supplies the command officer with the reasons for the denial in writing. The command officer shall have recourse through the grievance procedure in the event that he/she disagrees with the reasons set forth by the Public Safety Director. Individuals selected to fill the position of Detective Sergeant and Professional Standards Sergeant shall receive a 1% stipend over sergeant’s pay. A command officer assigned to a position outside the Patrol Operations Division shall have the opportunity to opt out of the position at the time of the annual shift selection process in August each year. Command officer positions outside the Patrol Operations Division, with the exception of command officer positions within the V.I.P.E.R. unit, shall be re-posted after a maximum of five (5) years from date of assignment unless otherwise vacated prior to five (5) years. Any resulting open position shall be filled in accordance with the provisions set forth in this section. Command officers who are not cross-trained as Public Safety Officers shall select their shifts by seniority, however, the Public Safety Director shall determine the number of non- cross-trained employees assigned to a shift reassignment must occur, it will be offered to volunteers based on seniority. If there are no volunteers it will be assigned to the least senior officer in the departmentPatrol Operations Division.
2. Shift selection shall be an appropriate subject for the Joint Labor/Management Committee.
3. If a shift becomes available as a result of trainees being released for duty, and if there is at least four (4) months until the next shift change, the shift will be posted and awarded by seniority. The new trainee released for duty will take the senior officers shift. If no employee desires the shift, the trainee scheduled for assignment will be assigned that shift. The parties recognize that for the betterment of the Department it may be necessary to assign a trainee to a specific shift.
4. Voluntary shift trades will be allowed as long as overtime costs are not incurred.
5. Except in a bona fide emergency, no employee shall be assigned to work more than sixteen (16) hours in a twenty-four (24) hour period, provided however employees may volunteer to work up to eighteen (18) hours in a twenty-four (24) hour period.

Shift Selection. Employee assignments within Upon sixty (60) days after the Patrol Bureau will occur between approximately April 1-15 approval and ratification of this Collective Bargaining Agreement, the Department may deploy a Day Cover Shift in Patrol. Said shift may consist of up to 21 officers for, and shall be awarded assigned to a District and to the supervisors specified by that District’s Commander. The Department shall post for volunteers for 14 days, after which time the Department may assign personnel via inverse department seniority or utilize the four (4) year provision of this Article to fill the assignments. If the Department determines to deploy a Day Cover Shift for subsequent years, said shift shall be included in the annual shift bidding process. All employees assigned to the shift shall work a 10 hour shift with the starting time of 1100 hrs and ending time of 2100 hrs and shall receive a $0.55 shift differential for hours worked on that shift. Up to half of the officers assigned to the Day Cover Shift may work a 10-hour shift with the starting time of 1200 hrs and ending time of 2200 hrs and shall receive a $0.55 shift differential for hours worked on that shift. A minimum of one Day Cover Shift employee shall be allowed on vacation at any given time. The Department shall not adjust the start times of any other patrol shifts for the balance of this CBA term absent agreement of the Union.
