Shipping Dates. Delivery, shipment and installation dates are estimated dates only, unless otherwise specified. All dates of shipment are contingent upon strikes, accidents, shortage of materials, delays of carriers, or causes which are unavoidable or beyond the control of Verantis Corporation.
Shipping Dates. Palm may ship before the scheduled shipment date, but not to arrive earlier than OEM Partner's requested delivery date. Palm will promptly notify OEM Partner if any order or part of an order cannot be filled or if there will be any delays in delivery. Palm will use all reasonable efforts to ship on indicated dates but will not be liable for failure to do so. If Palm fails to ship on the scheduled ship date, OEM Partner may reschedule without charge.

All quoted shipping schedules are approximate and will depend upon prompt receipt from Buyer of any drawings and other information necessary for the design and manufacture of the Equipment by Despatch. Delay time in return of approved drawings will extend the proposed shipping date(s). Seller shall not be liable for failure to meet shipping schedules, including, without limitation any penalty or liquidated damages claim, unless such timely delivery of the Products is specifically agreed to in writing by an officer of Seller. If Buyer delays shipment sixty (60) days or more beyond Despatch’s proposed shipping date, the purchase price is subject to adjustment at the time of shipment for any increase in labor, material or storage costs of Despatch occurred during any such period of delay. On the date Despatch is notified of delay, Buyer may be billed for work in progress, including engineering, fabrication and equipment, and components purchased from Despatch’s suppliers.
Shipping Dates. Shipping dates quoted represent a reasonable estimate of the time required for manufacturing at the time of order acceptance or quotation. These dates will not be construed as promises or contractual agreements to ship or deliver goods unless specifically agreed to in writing.
Shipping Dates. 4.1 NeoPhotonics will use commercially reasonable efforts to meet any shipping date(s) indicated in the quotation; provided however, that NeoPhotonics will not be liable under any circumstances for its failure to meet such shipping date(s). 4.2 NeoPhotonics shall have the right to make partial shipments and Buyer will make payment for the partial shipments as provided for in the Payment section.

Shipping Dates. The ship date will be stated by Av-DEC in the purchase order confirmation according to Av-DEC's best estimate, but will not be binding on Av-DEC. Buyer will have no other remedies for breach as a result of delay or non-delivery of products and is not entitled to make and hereby waives any claim for damages, consequential loss or other loss due to a delay in the delivery or non-delivery of any products.

Payment terms are net thirty (30) days from the date of invoice, which is the date of shipment. OEM Partner must give Palm written notice of any discrepancies among the purchase order, the invoice, and the Products received, within thirty (30) days after receipt of the Products or the invoice, whichever occurs later. Payment is not conditioned upon the Products meeting any acceptance testing procedures OEM Partner may have. If there is any dispute as to a part of a shipment, OEM Partner will pay for the undisputed part of that shipment. OEM Partner may not deduct any debit memos from payment(s) made to Palm on outstanding invoice(s), without prior written approval from the Palm Credit and Collections Department. Payments should be submitted to the appropriate address as stated on the invoice. 8.
Shipping Dates. Universal Display will use commercially reasonable efforts to meet Kyocera’s requests for specific shipment dates. Absent good cause, Kyocera shall in good faith accept and pay for partial deliveries on the terms set forth herein. However, nothing in this paragraph shall relieve Universal Display of its obligations hereunder with respect to confirmed shipping dates.
