The Site Specific Payments clause defines the payment terms and conditions that apply to particular project locations or sites. Site Specific Payments. Where the Company is obliged to make site specific payments (such as productivity, site disability and other contingencies specifically relating to the site) under prevailing industrial instruments, the following conditions will apply: (I) The company may, at its discretion, adopt some or all of those payments for the duration of that project. (II) Payments will only be made to or on behalf of employees where the Company is contractually entitled to recover the full cost of the payments. Payments will only apply while employees are engaged on the site or project.
Site Specific Payments. 5.6.1 Where the Company is obliged to make site specific payments (such as productivity, site disability and other contingencies specifically relating to the site) under prevailing industrial instruments properly certified under the Act, which in addition must also meet the requirements of 8.4 of the Construction Industry National Code of Practice and Implementation Guidelines, the following conditions will apply: (I) The Company may, at its discretion, adopt some or all of those payments for the duration of that project. (II) Payments will only be made to or on behalf of Employees where the Company is contractually entitled to recover the full cost of the payments. 5.6.2 Payments will only apply while Employees are engaged on the site or project. 5.6.3 Project Agreements cannot override the arrangements of this Agreement.
Site Specific Payments. 5.5.1 Where site specific payments are made on a project these payments must only be made in accordance with the following requirements: • The Company may, at its discretion, adopt some or all of those payments for the duration of that project. • Payments will only apply while Employees are engaged on the site or project. • Project Agreements cannot override the arrangements of this Agreement. • Site Specific payments cannot apply unless they are provided for in an industrial instrument approved by the FWC.
Site Specific Payments. The Parties acknowledge that from time to time, clients and head contractors who engage the Company will have site, project, or other agreements, including site rates agreements and site allowance agreements with trade unions and/or Employees directly. It is expressly agreed by the Parties that the terms and conditions of this Agreement will always prevail over (i.e., be in lieu of) the terms and conditions of such agreements, whether such agreements arise under contract, State or Federal industrial instrument or otherwise.

Site Specific Payments. Where there are site specific “Big Build” agreements or, allowances, entitlements, or other Enterprise Agreements or other payments that are made by the Principal Contractor or Construction Companies at a particular project or site, Employees covered by this Agreement will be entitled to all of the specific allowances, entitlements, site/ project Enterprise Agreements or other payments that are in excess of those provided for in this Agreement or that are not provided for in this Agreement for the duration of that project or work at that site, provided that: • Such allowances and payments will only apply while Employees are engaged on the project or site; and • Such payments are provided for in an instrument registered, lodged, or otherwise approved under the Fair Work Act; and • This clause will not be used to reduce any allowances entitlements or payments of this Agreement in any way.
Site Specific Payments. Where site specific allowances or other payments are made on a particular project or site, the Company will adopt those allowances and payments for the duration of that project or work at that site, provided that: • Such allowances and payments will only apply while Employees are engaged on the project or site; and • Such payments are provided for in an instrument registered, lodged, or otherwise approved under the Fair Work Act. • This clause will not be used to reduce the allowances and payments of this Agreement in any way. The Parties note specifically that the Agreement does not apply to: • Management, administrative and supervisory personnel; • Transportation or deliveries of material and or equipment to and from the Project (Other than the transport of machinery used in Tunnelling Works); • Engineers, technicians, surveyors, paramedics, nursing or medical support personnel; • Off-site manufacturing or fabrication of goods, materials or equipment; • Work on off-site infrastructure, whether associated with a Project or not; • Work performed by electrical or mechanical tradespersons; • Clerical and administration personnel; • Warranty, defects liability, repair and/or maintenance work performed by or on behalf of the manufacturers and/or distributors of gods, material or equipment provided to the Project; • Projects with a value under $5,000,000.
