Small and Local Business Program Requirements Clause Samples
The Small and Local Business Program Requirements clause establishes obligations for contractors or vendors to engage, support, or prioritize small and local businesses in the performance of a contract. Typically, this clause may require a certain percentage of subcontracting or procurement to be directed toward businesses that meet specific size or geographic criteria, or it may mandate reporting on efforts to include such businesses. Its core function is to promote economic opportunities for small and local enterprises, fostering community development and ensuring a more equitable distribution of contract benefits.
Small and Local Business Program Requirements. The City has adopted a Small and Local Business Enterprise (SLBE) program for consultant contracts. SLBE program requirements for consultant contracts are set forth Council Policy 100-10.
A. SLBE and ELBE Participation for Contracts Valued Over $50,000:
1. For all consultant contracts, the City shall apply a maximum of an additional 12 points for SLBE or ELBE participation, to the proposer’s subtotal maximum evaluation points.. Additional points will be awarded as follows to achieve the proposer’s final maximum evaluation points :
a. If the proposer achieves 20% participation, apply 5 points to the proposer’s score; or
b. If the proposer achieves 25% participation, apply 10 points to the proposer’s score; or
c. If the prime consultant is a SLBE or an ELBE, apply 12 points to the proposer’s score.
B. Subcontractor Participation List. The Subcontractor Participation List (Attachment CC) shall indicate the Name and Address, Scope of Services, Percent of Total Proposed Contract Amount, Certification Status and Where Certified for each proposed Subcontractor/Subconsultant.
Small and Local Business Program Requirements. The City has adopted a Small and Local Business Preference Program for goods and services contracts. The SLBE requirements are set forth in Council Policy 100-10. For goods, services, and consultant contracts in which the Purchasing Agent is required to advertise for sealed bids in the City’s official newspaper:
A. The City shall apply a bid discount in the way of:
a. Five percent (5%) discount off the bid price for SLBE or ELBE prime contractors; or
b. Five percent (5%) discount off the bid price for prime contractors achieving the voluntary goal of twenty percent (20%) for SLBE or ELBE subcontractor participation set forth in Subsection B below. The discount will not apply if an award to the discounted bidder would result in a total contract cost of $50,000 in excess of the low, non- discounted bid. In the event of a tie between a discounted bidder and non- discounted bidder, the discounted bidder will be awarded the contract. The discount shall be taken off the total contract value, including contract option years.
B. Include a voluntary subcontractor participation requirement of 20% of the total bid price for SLBE or ▇▇▇▇▇.

1. It is the City’s policy to encourage greater availability, capacity development, and contract participation by SLBE and ELBE firms in City contracts. This policy is, in part, intended to further the City’s compelling interest to stimulate economic development through the support and empowerment of the local community, ensure that it is neither an active nor passive participant in marketplace discrimination, and promote equal opportunity for all segments of the contracting community.

a) Failure to meet the mandatory goal or GFE submittal requirements may render Task Order to be rejected as non-responsive and ineligible for further consideration.

B. Subcontractor Participation.
1. For the purpose of satisfying subcontracting participation requirements, only 1st tier SLBE–ELBE Subcontractors will be recognized as participants in the Contract according to the following criteria:
a) For credit to be allowed toward a respective participation level, all listed SLBE- ELBE firms shall have been certified by the Proposal due date.
b) The Subcontractor shall perform a commercially useful function for credit to be allowed toward subcontractor participation levels. The Subcontractor shall be required by you to be responsible for the execution of a distinct element of the Work and shall carry out its responsibility by actually performing and supervising its own workforce.
