Common use of Space Availability Notification Clause in Contracts

Space Availability Notification. 6.4.1 Unless otherwise specified, BellSouth will respond to an application within ten (10) calendar days (In Mississippi, ten (10) business days) as to whether space is available or not available within a BellSouth Premises. BellSouth will also respond as to whether the Application is Bona Fide and if it is not Bona Fide the items necessary to cause the Application to become Bona Fide. With the exception of Georgia, this interval excludes National Holidays. If the amount of space requested is not available, BellSouth will notify ALEC Inc., of the amount of space that is available and no Application Fee shall apply. When BellSouth’s response includes an amount of space less than that requested by ALEC Inc.,, or differently configured , ALEC Inc., must resubmit its Application to reflect the actual space available. 6.4.2 BellSouth will respond to a Florida Application within fifteen (15) calendar days as to whether space is available or not available within a BellSouth Premises. BellSouth will also respond as to whether the Application is Bona Fide and if it is not Bona Fide the items necessary to cause the Application to become Bona Fide. If a lesser amount of space than requested is available, BellSouth will provide an Application Response for the amount of space that is available and an Application Fee will be assessed. When BellSouth’s Application Response includes an amount of space less than that requested by ALEC Inc., or differently configured, ALEC Inc., must amend its Application to reflect the actual space available prior to submitting Bona Fide Firm Order. 6.4.3 BellSouth will respond to a Louisiana Application within ten (10) calendar days for space availability for one (1) to ten (10) Applications; fifteen (15) calendar days for eleven (11) to twenty (20) Applications; and for more than twenty (20) Applications, it is increased by five (5) calendar days for every five additional Applications received within five (5) business days. If the amount of space requested is not available, BellSouth will notify ALEC Inc., of the amount of space that is available and no Application Fee shall apply. When BellSouth’s response includes an amount of space less than that requested by ALEC Inc., or differently configured, ALEC Inc., must resubmit its Application to reflect the actual space available. BellSouth will also respond as to whether the Application application is Bona Fide and if it is not Bona Fide Fide, the items necessary to cause the Application application to become Bona Fide. If a lesser amount of space than requested is available, BellSouth will provide an Application Response for the amount of space that is available and bill NOS Communications, Inc. an appropriate application fee on the date that BellSouth provides the Application Fee will be assessedResponse. When BellSouth’s Application Response includes an amount of space less than that requested by ALEC Inc.NOS Communications, Inc. or differently configuredspace that is configured differently, ALEC Inc.if NOS Communications, Inc. decides to accept the available space, NOS Communications, Inc. must amend its Application application to reflect the actual space available available, including the configuration of the space, prior to submitting Bona Fide Firm Ordera BFFO. 6.4.3 6.5.3 BellSouth will respond to a Louisiana Application application within ten (10) calendar days for in regard to space availability for one (1) to ten (10) Applicationsapplications; fifteen (15) calendar days for eleven (11) to twenty (20) Applicationsapplications; and for more than twenty (20) Applicationsapplications, it the response interval is increased by five (5) calendar days for every five additional Applications applications received within five (5) business days. If NOS Communications, Inc. decides to accept the available space, NOS Communications, Inc. must resubmit its Application application to reflect the actual space available, including the configuration of the space, prior to submitting a BFFO. When NOS Communications, Inc. resubmits its application, BellSouth will also respond as bill NOS Communications, Inc. the appropriate application fee. Denial of Application. If BellSouth notifies NOS Communications, Inc. that no space is available (Denial of Application), BellSouth will not assess an application fee to whether NOS Communications, Inc.. After notifying NOS Communications, Inc. that BellSouth has no available space in the Application is Bona Fide and if it is not Bona Fide requested Premises, BellSouth will allow NOS Communications, Inc., upon request, to tour the items necessary entire Premises within ten (10) calendar days of such Denial of Application. In order to cause schedule this tour within ten (10) calendar days, the Application to become Bona Fiderequest for the tour of the Premises must be received by BellSouth within five (5) calendar days of the Denial of Application.
