STRIKES AND LOCKOUTS 2. Section 8.1 Neither the Union (including its officers, agents, representatives, and 4 members) nor any employee covered by this Agreement shall in any way, directly or 5 indirectly, authorize, cause, assist, encourage, participate in, ratify, or condone any 6 strike (whether it be an economic strike, sympathy strike, or otherwise), slowdown, 7 walkout, boycott, picketing (including informational picketing), handbilling, or any 8 other interference with the Company’s operations, including any refusal to cross any 9 other labor organization’s or other party’s picket line. Any employee who violates 10 this article shall be subject to disciplinary action. 11 Section 8.2 In addition to any other liability, remedy, or right provided by this 13 Agreement or applicable law, should a violation of this article occur, the Union, 14 within 24 hours of a request by the Company, shall: 15 16 8.2(a) Publicly disavow such action by the employees. 17 18 8.2(b) Advise the Company in writing that such action by the employees has 19 not been called or sanctioned by the Union. 20 Section 8.3 The Company agrees that there shall be no form of lockout during the 22 term of this Agreement. 23 Section 8.4 Any claim by either the Company or the Union that this article has 25 been violated shall not be subject to the grievance and arbitration provisions of this 26 Agreement, and either party shall have the right to submit such claim to the courts. 27 1 ARTICLE 9
