Common use of Strikes - Walkouts Clause in Contracts

Strikes - Walkouts. An employee covered under this Agreement may refuse to cross or work behind a legally constituted picket line as defined under the Labour Relations Code. Failure to cross such a picket line shall not be considered a violation of this Agreement nor shall it be grounds for disciplinary action by the Board unless the picket line has been deemed to be illegal under the Labour Relations Code. Discipline shall not be retroactive. An employee failing to report to work when faced with a picket line shall be considered absent without pay. It is the responsibility of the Board to determine the legal status of the picket line through the procedures set out in the Labour Relations Code or the courts. The Board shall not request, require, nor direct an employee covered under this Agreement to do work or carry out duties normally performed by an employee engaged in a strike or locked out, nor shall an employee request, require, or direct others not covered by this Agreement to carry out such duties.
