Testing Period. Prior to the Facility’s Commercial Operation Date Seller may test the capability of the Facility to operate and generate the Product in accordance with this Agreement (such operational period, the “Testing Period”). Seller shall provide Buyer with written notice of a date certain on which Seller desires to initiate the Testing Period. After the Facility has achieved the Commercial Operation Date, the Buyer shall, expressly subject to the limitations set forth below, purchase the Product produced by the Facility during the Testing Period at the applicable Contract Price set forth in Exhibit 2, but expressly subject to the Buyer fully satisfying the following conditions: (i) the Testing Period shall not exceed sixty (60) days; (ii) the RECs shall meet all of the requirements set forth in this Agreement; and, (iii) Seller shall certify in writing to Buyer, and to Buyer’s satisfaction, together with supporting details, that each unit of the Product (including the associated REC) to be sold and purchased during the Testing Period was generated in compliance with the requirements of this Agreement. To the extent Seller is unable to satisfy the foregoing requirements; the Buyer shall purchase the Energy generated by the Facility at the rate for the Energy-only component of the Product set forth in Exhibit 2.
Testing Period. That certain period of time, consisting of the Initial Testing Period and any effective Testing Period Renewal Term, that occurs on the Effective Date of the Agreement and during which Grantee may investigate the feasibility of constructing and operating a wireless telecommunications facility on the Premises as further provided in Section 2.
Testing Period. (a) As from [date determined by the Parties], the Producer shall be entitled to inject Power into the network provided that the following conditions precedent are fulfilled (the Testing Period): (i) all conditions precedent to the first utilisation of the Facilities Agreement have been fulfilled or waived as confirmed by a statement provided by the Lenders; (ii) the Wind Farm has been attached to the Balancing Group by way of designation by the Producer of the entity designated as Balance Responsible Entity by the Buyer; (iii) the Producer has notified the Buyer in writing at least [five (5)] Business Days prior to such date of the beginning of the Testing Period. (b) The Testing Period shall be automatically terminated on the Supply Period Commencement Date, in accordance with the provisions of Clause 2.3 below.
Testing Period. (a) The chromatograph analysis and other tests shall be made by Buyer semiannually, except when, in the opinion of either party, a change in the method of operation of the lease(s) or well(s) connected to Seller’s Gathering System will affect materially the Gas composition, specific gravity and/or hydrogen sulfide content of the Gas, in which event the tests shall be made at the demand of either party upon five (5) days’ notice to the other party. (b) Buyer shall notify Seller in writing ten (10) days prior to the semiannual tests in order that it may have a representative present to witness said tests and/or make joint tests with its own appliances.

(b) The Testing Period shall be automatically terminated on the Supply Period Commencement Date, in accordance with the provisions of Clause 2.3 au-dessous.

Testing Period. Subject to the terms and conditions hereof, Lender will commit to fund Loans originated as part of the GreenSky® Program that meet the Underwriting Criteria up to a maximum of [*****] dollars ($[*****].00) in aggregate outstanding principal balances held on Lender’s balance sheet at any time (as it may be increased in accordance with Section 2.01(a), the “Commitment Amount”) for a period commencing [*****]. Testing Period. Kayak acknowledges that it has been informed by ITA that for so long as Kayak communicates with the ITA Data Center over the Internet, the Kayak server farm will he considered a “test farm” and not a “production farm.” Accordingly, while ITA will exercise reasonable commercial efforts to comply with the various provisions of this Exhibit B. Kayak agrees that, until Kayak has installed and begun using dedicated private lines to communicate with the Data Center, (i) under no circumstances will ITA le obligated to Kayak for any penalties, liabilities or credits (including but not limited to credits for downtime) resulting from any failure of ITA to comply with this Exhibit 11 and (ii) no problems will be classified as “emergency problems”.
Testing Period. (a) When the construction of the Regional MSW Facility has been completed, the Concessionaire shall so notify the Project Engineer in writing. Thereafter, the Project Engineer shall, within seven (7) days of the receipt of such notice, cause the Regional MSW Facility to be inspected. (b) Once the Project Engineer has inspected the Regional MSW Facility, the Project Engineer shall issue a Partial Readiness Certificate and the Testing Period of the Regional MSW Facility shall commence from the date of issuance of Partial Readiness Certificate. (c) During the Testing Period, which is a period of maximum of [ three ] months, the Project Engineer shall inspect Regional MSW Facility in presence of the representatives of the Concessionaire so as to ascertain any material defects, imperfections, shortcomings or any other faults in the operation of the Regional MSW Facility and shall direct the Concessionaire to remedy such defects. During this Testing Period, the Project Engineer may also supervise any trial runs and/or performance tests to be conducted under his supervision. (d) The Concessionaire shall rectify the defects and on the completion of all the works in relation to the correction of defects stipulated by the Project Engineer in sub-clause
Testing Period. (a) When the construction of the Regional MSW Facility has been substantially completed the Concessionaire shall so notify the Project Engineer in writing. Thereafter, the Project Engineer shall, within (7) seven days of the receipt of such notice, cause the Regional MSW Facility to be inspected. (b) Once the Project Engineer has inspected the Regional MSW Facility, the Project Engineer shall issue a Partial Readiness Certificate and the Testing Period of the Regional MSW Facility shall commence from the date of issuance of Partial Readiness Certificate. (c) During the Testing Period, which is a period of maximum of three (3) months, the Project Engineer shall inspect Regional MSW Facility in presence of the representatives of the Concessionaire so as to ascertain any material defects, imperfections, shortcomings or such other faults. During this Testing Period, the Project Engineer may also require any trial runs and/or performance tests under his supervision. (d) The Project Engineer on being satisfied that (i) all the works stipulated in sub-clause 11.2 above have been completed; (ii) there are no defects which need remedied; and (iii) the Regional MSW Facility can be used and operated for the treatment and disposal of MSW, the Project Engineer shall issue a Readiness Certificate. (e) If any latent defect or other defect not in the nature of a defect specified in subsection (c) above appears in the Project during the Term, the Concessionaire shall undertake to make any repairs or take any remedial measures that are reasonably required to remedy any such defect. Such repairs or remedial measures shall be taken up as part of the Operations and Maintenance of the Project under this Agreement. (f) For the purposes of conducting trial runs and performance tests as provided under Clause 11.4, the Grantor ULB and Participating ULBs at their own cost and expense shall provide a Testing MSW Quantity to the Concessionaire after the Concessionaire submits a written request to the Project Engineer in relation to such Testing Quantity.
