THE ENGINEER AGREES. 1. To perform or be responsible for the performance, in accordance with STATE approved design standards and policies, of engineering services for the LA for the proposed improvement herein described.
2. To attend any and all meetings and visit the site of the proposed improvement at any reasonable time when requested by representatives of the LA or STATE.
3. To complete the services herein described within calendar days from the date of the Notice to Proceed from the LA, excluding from consideration periods of delay caused by circumstances beyond the control of the ENGINEER.
4. The classifications of the employees used in the work should be consistent with the employee classifications and estimated man- hours shown in EXHIBIT A. If higher-salaried personnel of the firm, including the Principal Engineer, perform services that are indicated in Exhibit A to be performed by lesser-salaried personnel, the wage rate billed for such services shall be commensurate with the payroll rate for the work performed.
5. That the ENGINEER is qualified technically and is entirely conversant with the design standards and policies applicable for the PROJECT; and that the ENGINEER has sufficient properly trained, organized and experienced personnel to perform the services enumerated herein.
6. That the ENGINEER shall be responsible for the accuracy of the work and shall promptly make necessary revisions or corrections resulting from the ENGINEER’s errors, omissions or negligent acts without additional compensation. Acceptance of work by the STATE will not relieve the ENGINEER of the responsibility to make subsequent correction of any such errors or omissions or for clarification of any ambiguities.
7. That all plans and other documents furnished by the ENGINEER pursuant to this AGREEMENT will be endorsed by the ENGINEER and will affix the ENGINEER’s professional seal when such seal is required by law. Plans for structures to be built as a part of the improvement will be prepared under the supervision of a registered structural engineer and will affix structural engineer seal when such seal is required by law. It will be the ENGINEER’s responsibility to affix the proper seal as required by the Bureau of Local Roads and Streets manual published by the STATE.
8. That the ENGINEER will comply with applicable federal statutes, state of Illinois statutes, and local laws or ordinances of the LA.

THE ENGINEER AGREES. 1. The ENGINEER shall serve as the VILLAGE'S professional construction engineering consultant in those phases of the PROJECT to which this AGREEMENT applies. The ENGINEER shall perform the Engineering Services described in its proposal dated August 17, 2022, entitled “▇▇▇▇▇▇▇ Pond Expansion Project – Construction Engineering Services – Villa Park, Illinois”, attached hereto as Exhibit A and made a part hereof.
2. Additional services beyond the scope of the Engineering Services above- described, requested in writing by the VILLAGE, shall be performed by the ENGINEER in accordance with the hourly rate as agreed upon in writing between the VILLAGE and ENGINEER, and approved by the VILLAGE Board of Trustees.
3. The ENGINEER will perform services under this AGREEMENT in accordance with generally accepted and currently recognized engineering practices and principles, and in a manner consistent with that level of care and skill ordinarily exercised by members of the profession currently practicing in the Chicagoland area. Notwithstanding anything to the contrary which may be contained in this AGREEMENT or any other material incorporated herein by reference, or in any agreement between the Village and any other party concerning the PROJECT, the ENGINEER shall not have control or be in charge of, and shall not be responsible for the means, methods, techniques, sequences or procedures of construction, or the safety, safety precautions or

The ENGINEER shall procure and maintain for the duration of its AGREEMENT, and for three years thereafter, insurance against errors and omissions and claims for injuries to its employees which may arise from, or are in conjunction with, the performance of the work hereunder by the ENGINEER, its agents, representatives, employees, or subcontractors.

(1) Insurance Services Office Commercial General Liability occurrence form CG 0001 (Ed. 11/85);
(2) Insurance Services Office form number CA 0001 (ed. 1/87) covering Automobile Liability, symbol 01 “any auto” and endorsement CA 0029 (Ed. 12/88) changes in Business Auto and Truckers coverage forms - Insured Contract or ISO form number CA 0001 (Ed. 12/90);
(3) Professional Liability/Malpractice Liability policy; and
(4) Worker’s Compensation as required by the Labor Code of the State of Illinois and Employers’ Liability insurance.

THE ENGINEER AGREES. 1. To review all data prepared for these projects by ▇▇▇▇▇▇ County.
2. To perform a field survey of the site in English units to obtain information necessary for the preparation of approach grading and bridge plans. Field survey will be tied to the nearest section corners and half section corners and to the nearest USGS datum benchmark. Survey will include all topographic and elevation survey work to establish all identifiable utilities, underground lines, road profiles, flow lines of drainage structures, hydraulic calculations and cross sections necessary to complete the work. Survey will also establish property line to the extent necessary to develop legal descriptions for the purchase of right of way.
3. To plot field survey data and establish preliminary roadway, bridge and channel alignment concepts for the proposed improvement.
4. To prepare and submit preliminary plans with the roadway alignment, bridge location and size, and channel work for review and comment by ▇▇▇▇▇▇ County. All approach grading design and bridge design shall meet the current minimum requirements of KDOT and AASHTO for County +rural secondary routes and bridge structures.
5. To prepare field check plans based on preliminary plans submitted to the County and furnish the required electronic set of plans and construction cost estimates to the County.
6. To Field Check the plans of the project with representatives of the County.
7. To prepare office check plans for the Project in compliance with the field check recommendations.
8. To hire a geotechnical firm and obtain soundings for the substructure elements of the proposed bridge. A copy of the report will be transmitted to the County.
9. To prepare right of way descriptions and survey plats for use of the County in the acquisition of right of way.
10. To prepare and submit applications for the required permits to Division of Water Resources, the Kansas Department of Health and Environment and the United States Army Corps of Engineers.
11. To submit one set of prints of the office check plans prepared under 7 above to the County and an electronic pdf set to the County for office check approval along with a construction cost estimate

13. To furnish one set of final plans in electronic format to the County along with a Construction Cost Estimate for bidding.
