The 'Time of receipt of notice' clause defines when a notice sent under the contract is considered officially received by the intended party. Time of receipt of notice. A notice given to a party in accordance with the clause is treated as having been given and received: 15.2.1 if delivered to a person’s address, on the day of delivery if a business day, otherwise on the next business day; 15.2.2 if sent by pre-paid mail, on the third business day after posting; 15.2.3 if transmitted by facsimile to a person’s facsimile number and a correct and complete transmission report is received, on the day of transmission if a business day, otherwise on the next business day; or 15.2.4 if sent by electronic mail and the sender does not receive a message from its internet service provider or the recipient's mail server indicating that it has not been successfully transmitted, on the day of sending if a business day, otherwise on the next business day.

Any notice sent by facsimile shall be deemed to have been received upon production of a transmission report by the machine from which the facsimile was sent which indicates that the facsimile was sent in its entirety to the facsimile number of the recipient and provided that a hard copy of the notice so served by facsimile was posted or delivered by hand on the same day as the notice was served by facsimile or on the immediately subsequent day. Any notice received or deemed to be received on a Saturday, Sunday or public holiday in Hong Kong shall be deemed to have been received on the next Business Day.

The date of deemed receipt of an invoice will be extended by each day that the supporting documentation relating to the invoice is delivered after delivery of the invoice summary statement.
