Timely Action. 16.3.1 If corrective action is necessary, the procedures in this article shall be initiated in a timely manner so that the unit member has an opportunity to correct and improve his or her conduct as soon as possible. 16.3.2 All time lines in this Article may be waived by mutual agreement. A workday for the purposes of this Article shall be a day in which the central administrative office of the District is open for business.

Timely Action. Notwithstanding anything herein to the contrary, as a condition precedent to Purchaser exercising any right it may have to bring an action for specific performance hereunder, Purchaser must commence such an action within 30 days after Purchaser’s knowledge of the occurrence of the actual or alleged breach or failure to perform under this Agreement by a Seller Party. Purchaser agrees that its failure to timely commence such an action for specific performance within such 30 day period shall be deemed a waiver by it of its right to commence an action for injunctive relief or specific performance as well as a waiver by it of any right it may have to file or record a notice of lis pendens or notice of pendency of action or similar notice against any portion of the Purchased Assets.

Timely Action. Purchasing Partners will make decisions and communicate information in a timely manner to enable PHx to provide the Services in accordance with this Agreement.

Timely Action. The City acknowledges and agrees that it is desirable for the Owners to proceed rapidly with the implementation of this Agreement and the development of the Property and that, accordingly, a reasonably timely approval, review and construction inspection process is necessary. The parties agree that if no substantive good faith review or final decision by City staff has occurred within normal City timeframes regarding review of applications, plans, permit requests or any other similar action, the Owners shall have the right to immediately appeal to the City Manager for an expedited decision pursuant to this paragraph. The City Manager shall provide the Owners with a decision within 15 working days after the Owners’ written request for an expedited decision under this Section 41.
