Common use of Transfer Out of Bargaining Unit Clause in Contracts

Transfer Out of Bargaining Unit. An employee who is transferred to a position outside of the bargaining unit with the Board shall retain seniority for a period of one (1) year from the time of transfer. If during the one (1) year period the employee is transferred back to the bargaining unit, employee shall return to any unbid posted vacancy that exists that the employee is qualified to perform. If no such vacancy exists, the employee shall if qualified, displace the lowest seniority employee in the bargaining unit, in accordance with provisions of Section D above.

An employee who is transferred accepts a transfer to a position outside of the bargaining unit with the Board shall retain continue to accumulate seniority for a maximum period of one (1) year from the time of transferyear. If If, during the that one (1) year period period, the employee is transferred wishes to return to the bargaining unit, or the Company wishes to transfer the employee back to the bargaining unit, employee shall return to any unbid posted vacancy that exists that the employee is qualified to perform. If no such vacancy exists, the employee shall if qualified, displace the lowest seniority employee be reinstated in the bargaining unit, in accordance with provisions of Section D abovehis previous position.
