Transfer to Positions Outside of the Bargaining Unit. An employee who is transferred to a position outside the bargaining unit for a period of up to twelve (12) months, or such longer period of time as may be agreed by the Local Union and the Hospital, shall retain but not accumulate seniority held at the time of the transfer. In the event the employee is returned to a position in the bargaining unit she shall be credited with the seniority held at the time of transfer and resume accumulation from the date of her return to the bargaining unit.

Transfer to Positions Outside of the Bargaining Unit i) A nurse who is transferred to a position outside of the bargaining unit shall continue to accrue seniority for a period of up to three (3) months, and shall not suffer any loss of service or benefits. ii) A nurse who is transferred to a position outside of the bargaining unit for a period of more than three (3) months, but not more than twelve (12) months, shall retain but not accumulate seniority. iii) A nurse must remain in the bargaining unit for a period of at least three (3) months before transferring out of the bargaining unit again or the nurse will lose all seniority held at the time of the subsequent transfer. iv) A nurse who is transferred to a position outside of the bargaining unit for a period of more than twelve (12) months, the nurse will lose all seniority held at the time of transfer.

This term may be extended up to a further six (6) months on mutual agreement of the Union, nurse and Employer.

Such six (6) month period may be extended upon agreement of the Union.

(c) An employee must remain in the bargaining unit for a period of at least three (3) months before transferring out of the bargaining unit again or he or she will lose all seniority held at the time of the subsequent transfer.

  • Work of the Bargaining Unit (a) In order to protect the standard of nursing care, the Employer shall not contract out the work normally performed by members of this bargaining unit except: i) For purposes of instruction, ii) In the event of an emergency situation, iii) When performing developmental or experimental work, or iv) When employees are not available due to an employee not reporting for work as scheduled or not being available for work. (b) Reassignment to other employees of work normally performed by members of the bargaining unit shall not result in the termination, layoff or reduction in hours of any member of the bargaining unit. (c) When it is decided to not fill a position following an employee’s resignation, the Home will provide the rationale in writing for this decision to the Union. The Union may request a meeting to make representations on this matter.
