NATURE OF THE BARGAINING UNIT. 1.01 The Employer recognizes the Union as the sole and exclusive bargaining agency for all of its employees working at The Fairmont Winnipeg, in the City of Winnipeg, in the Province of Manitoba, save and except the Administrative/Clerical persons employed in the Sales/Marketing and Catering departments, those persons employed in the Engineering/Maintenance, Accounting and Human Resources departments, Security staff, Supervisors, Managers, those above the rank of Supervisor and/or Manager and those excluded by the Act. 1.02 The Employer agrees not to increase the number of Assistant Banquet Managers excluded from the bargaining unit beyond six (6) except for legitimate business reasons. When doing so, the Employer shall inform the Union. 1.03 The Employer shall provide the Union with a list containing the current names, social insurance numbers, classifications and rates of pay of all bargaining unit employees, whenever a written request to do so is received from the Union. The Union agrees that it will not make such request more often than once in a calendar year. 1.04 The parties recognize that employees of the Employer in supervisory positions, or above the rank of Supervisor, may (when the situation so requires) help employees covered by this collective agreement in order to maintain the quality of service to customers, and in this case may also perform work currently done by current employees of the bargaining unit. Such work must not, however, cause the elimination of any position now covered in the collective agreement. (a) will not apply. Notwithstanding the foregoing, an employee of the Employer working in a position not covered by the collective agreement, may continue work presently being performed but shall not assume additional duties if this would cause the elimination of a position now covered in the collective agreement.
NATURE OF THE BARGAINING UNIT. 1.01 The Employer recognizes the United Food and Commercial Workers Union, Local No. 832, as the sole and exclusive bargaining agent for all employees of Fort La ▇▇▇▇▇ School Division, employed as bus drivers, custodial and maintenance employees, and school administrative assistants in the Province of Manitoba, save and except the Supervisor of Operations, Managers, those above the rank of Manager and those excluded by the Act.
NATURE OF THE BARGAINING UNIT. 1.01 a) The Employer recognizes the Union as the sole agency for the purpose of collective bargaining for all employees, whether full-time or part-time, coming under the provisions of this Agreement, employed in the stores owned and/or operated by the Employer in the Province of Manitoba, save and except one (1) Store Manager per store, one (1) First Assistant Store Manager per store, one (1) Health and Wellness Manager per store, one (1) Registered Dietician per store, one (1) Pharmacy Manager per store, and Graduate and Undergraduate Pharmacists, Registered Pharmacy Technicians if and when the Province of Manitoba enacts such a designation, and those currently excluded as of November 15, 1998.

Operating as Shoppers Drug Mart #539 in the City of Winnipeg, in the Province of Manitoba, save and except one (1) Associate Owner, Associate Owner's spouse, Associate Owner’s father, Controller, one (1) Store Manager, one (1) Receiver/Merchandise Manager, one (1) Cosmetics Manager, one (1) Head Cashier, one (1) Post Office Manager, one (1) Photo Lab Manager, all Graduate and Undergraduate Pharmacists, Registered Pharmacy Technicians, those above that rank, and those excluded by the Act. 1.02 The Company agrees to provide the Union, once a year or when changes are made, with a list of names of all employees excluded from the Agreement.
NATURE OF THE BARGAINING UNIT. 1.01 The Company agrees to recognize the Union as the sole agency for the purpose of collective bargaining for all employees, whether full-time or part-time, working in all present and future retail food stores and “combination” stores of Loblaw Companies Ltd. in the Province of Manitoba, its wholly owned subsidiary companies or its related corporate entities or its successor in title or in law, carrying on business as Retail Food Merchants or carrying on business or operation that is a Combination Store including Retail Food in the Province of Manitoba, effective May 10th, 1981, with the exclusion of positions as indicated in this Agreement and other exclusions as may be mutually agreed to from time to time.
NATURE OF THE BARGAINING UNIT. 1.01 The Employer recognizes the Union as the sole and exclusive bargaining agent for the purpose of collective bargaining for all employees of the Chalet ▇▇▇▇▇▇▇ Inc., in St. Malo, in the Province of Manitoba, employed in the housekeeping and food services area. 1.02 The Employer agrees to advise the Union, once a year, or when changes are made, of all the employees excluded by any Agreement.
NATURE OF THE BARGAINING UNIT. 2.01 The Company recognizes the Union as the sole and exclusive bargaining agent for all employees of the Gas Bars, in the Province of Manitoba, except for the Gas Bar Operator and persons above this rank. Should one (1) of the Gas Bar locations require an excluded management representative, the Union agrees to recognize one (1) excluded position per location.
NATURE OF THE BARGAINING UNIT. 1.01 The Employer recognizes the Union as the sole and exclusive bargaining agency for all Support Workers and Apartment Counsellors employed by the Association for Community Living (Interlake Branch) Inc., in the Town of Stonewall, Province of Manitoba, pursuant to Certificate No. MLB-5965. 1.02 Persons excluded from the bargaining unit shall not perform work normally performed by members of the bargaining unit unless no bargaining unit member is available, willing and capable of performing the normal functions of the job requirements. This clause will not prevent the direction, instruction or training of bargaining unit members, assistance of volunteers not displacing bargaining unit members or emergency aid when safety of client or employee is affected. 1.03 Outside agencies shall only be utilized to do bargaining unit work when employees are not available or not capable of performing the work required.
NATURE OF THE BARGAINING UNIT. 1.01 The Co-operative recognizes the Union as the sole agency for the purpose of collective bargaining for all employees of the Red River Cooperative Ltd. food store in the town of Lorette, Province of Manitoba, save and except one (1) Store Manager, one (1) Front End Manager, Department Managers, one (1) Health and Wellness Advisor, Graduate and Undergraduate Pharmacists, Registered Pharmacist Technicians, and those excluded by the Act. 1.02 Two (2) Management Trainees shall be included in the bargaining unit. The Co-operative agrees that not more than two (2) Management Trainees shall be on staff at any one time unless otherwise mutually agreed between the Co-operative and the Union and limited to one (1) per department. The Co-operative shall retain the sole right and function in respect to promotions, and demotions and the Union agrees that promotions and demotions, in respect to bargaining unit employees referred to in this Article shall not be subject to the grievance and arbitration articles provided in this Agreement. The Co-operative shall provide the Union with advance written notification of any Management Trainees who are to be so employed. 1.03 The Co-operative shall provide the Union in January and July of each calendar year and whenever changes are made, with a list containing the names and classifications of all employees excluded from the Collective Agreement. 1.04 The Co-operative shall provide the Union in January and July of each calendar year with an electronic Excel spreadsheet containing the current names, Social Insurance Numbers, employee numbers, addresses, telephone number(s), classifications, Department, status (full-time/part-time), start date, seniority date, birthdates, gender and hourly rates of pay of all bargaining unit employees.
NATURE OF THE BARGAINING UNIT. 1.01 The Employer recognizes the Union as the sole and exclusive bargaining agency for all employees employed at Wings of Power Family and Community Resource Centre, in the Town of Pine Falls, in the Province of Manitoba, save and except the Receptionist, Maintenance, Registered Dietician Coordinator, Program Director, Assistant to the Executive Director, and those above the rank of Assistant to the Executive Director, and those excluded by the Act pursuant to Certificate No. MLB-6887. 1.02 Residential Home, CPNP and Little Wings managers excluded from the bargaining unit shall be able to perform work normally performed by members of the bargaining unit provided they are not displacing bargaining unit members. However, as long as there are bargaining unit members available to work, they shall not do bargaining unit work in excess of their regular forty (40) hours per week. Managers shall only be allowed to work overtime after all bargaining unit members have been offered the opportunity in accordance with Article 19.04. 1.03 The Employer shall not contract out current work being performed by unionized employees except in cases of emergency.
