Transfers and Seniority Outside Bargaining Unit. No employee shall be transferred or promoted to a position outside the Bargaining Unit without the employee's consent. Where an employee is voluntarily transferred or promoted outside the Bargaining Unit, he/she shall retain his/her seniority acquired at the date of leaving the unit, but will not accumulate any further seniority. Such an employee shall have the right to return to his/her position in the Bargaining Unit within forty (40) working days. After forty (40) working days, such an employee may return to the Bargaining Unit only under Article 12.02 (b).
