Tree Pruning Clause Samples

The Tree Pruning clause outlines the responsibilities and procedures for trimming, cutting, or removing branches from trees on a property. Typically, this clause specifies which party—such as a tenant, property owner, or contractor—is responsible for maintaining trees to prevent hazards, property damage, or interference with utilities. For example, it may require regular pruning to keep branches clear of power lines or neighboring properties. The core function of this clause is to ensure safety, maintain property aesthetics, and prevent disputes or liability arising from neglected tree maintenance.

Tree Pruning. Trees shall be maintained with clear trunks with lower branch elevations to 10 feet. Tree interior sucker branches and dead wood shall be removed up to a height not exceeding 12' from ground. ▇▇▇▇ removal and tree spraying may be performed at an additional charge.
Tree Pruning. Contractor shall prune trees only at time of planting and according to standard horticulture practices to preserve the natural character and branch structure of the tree. The Contractor shall remove all dead or broken branches and competing terminal branches at time of planting.
Tree Pruning. (a) A ‘Pruning Specification Report’ prepared by a qualified Arborist (minimum AQF Level 5) must be submitted to and approved by Council’s Area Planning Manager prior to the issuing of the Construction Certificate. The report must include: (i) Number of branches and orientation, branch diameter, percentage of canopy to be pruned/removed. (ii) Photos with individual branches which are recommended for pruning/removal to be clearly marked. (Please note reports which include photos with a single vertical line as the area recommended for pruning will not be accepted). (iii) A maximum of 5% canopy removal and maximum of 100mm diameter branches will be permitted by Council. (iv) Pruning work must be specified in accordance with Australian Standard 4373–2007, Pruning of Amenity Trees. (v) Tree removal must not be recommended in this report. (b) All approved tree pruning works must be carried out by a qualified Arborist, with a minimum Level 3 AQF in arboriculture and in accordance with WorkCover’s Code of Practice – Amenity Tree Industry. (c) Any pruning works carried out under this consent must not result in the death of the tree, the creation of a hazard or in excessive or inappropriate amounts of pruning, which result in the overall shape of the tree becoming unbalanced and/or unstable. (d) The consent from Council’s Tree Management Officer must be obtained prior to the undertaking of any additional tree pruning works or pruning of any tree roots greater than 30mm in diameter.
Tree Pruning. Pruning of city trees shall be performed as necessary to (1) raise the lower branches to maintain a 15’ clearance above streets and roadways; (2) raise the lower branches to maintain a 7’ clearance above sidewalks and walkways; (3) to remove suckers, water sprouts, and other undesirable growth; (4) remove all dead or damaged branches; (5) eliminate visibility obstructions at corners or intersections, and (6) to clear obstructions of traffic signals.
Tree Pruning. (private property)
Tree Pruning. The Contractor shall meet with the City Representative to determine the objectives below. a. Structural Pruning is the removal of branches and stems to influence the orientation, spacing, growth rate, strength of attachment, and ultimate size of branches and stems. Structural pruning is used on young and medium-aged trees to encourage a sustainable trunk and branch arrangement. b. Crown Pruning or “cleaning out” is the removal of dead, diseased, crowded, weakly attached and low-vigor branches and water sprouts from the entirety of the tree crown. This type of pruning is done to reduce the risk of branches falling from the tree and to reduce the movement of decay, insects, and diseases from dead or dying branches into the rest of the tree. Cleaning is the preferred pruning type for mature trees. c. Crown Reduction is used to reduce the height and/or spread of a tree. Reduction is the selective removal of branches and stems to decrease the height and/or spread of a tree or shrub. This type of pruning is done to minimize the risk of failure, to reduce height or spread, for signal or street-light clearance, to clear vegetation from buildings or other structures, or to improve the appearance of the tree. d. Crown Restoration is corrective pruning used to restore the form of crowns that have been previously damaged by extenuating circumstances. Restoration is the selective removal of branches, sprouts, and stubs from trees that have been lion tailed, broken in a storm, or otherwise damaged. The goal of restoration is to improve a tree structure, form, or appearance. e. Crown Raising is the removal of lower branches of a tree to provide clearance for signage, buildings, vehicles and pedestrians. It is important that a tree have at least one-half of its foliage on branches that originate in the lower two-thirds of its crown to ensure a well-formed, tapered structure and to uniformly distribute stress within the tree. f. Palm Pruning consists of maintaining the crowns and trunks of palm trees including the pruning of dead or declining fronds, seed pods and the skinning or shaping of spent petiole bases into a ball or nut as applicable by palm type. The Contractor will not use climbing spikes to prune palms. Contractor will be responsible for removing any remaining “hanging” fronds after pruning activities have ceased.
Tree Pruning. The consent from Council’s Tree Management Officer must be obtained prior to the undertaking of any tree pruning works, including tree roots greater than 30mm in diameter. Only minor pruning works will be approved by Council.
Tree Pruning. (a) A Pruning Specification Report prepared by a qualified Arborist (minimum AQF Level 5) must be submitted to and approved by Council’s Area Planning Manager prior to the issuing of the Construction Certificate. The report must include: (i) Number of branches and orientation, branch diameter, percentage of canopy to be pruned/removed. Pruning to facilitate temporary scaffolding, hoarding, pilling and rigging must be included in the report. (ii) Photos with individual branches which are recommended for pruning/removal to be clearly marked. (Please note reports which include photos with a single vertical line as the area recommended for pruning will not be accepted). (iii) A maximum of 10% canopy removal and maximum of 100mm diameter branches for all tree to be retained will be permitted by Council (excludes Tree 51). (iv) Pruning work must be specified in accordance with Australian Standard 4373–2007, Pruning of Amenity Trees. (v) Tree removal must not be recommended in this report. (b) The total percentage of canopy to be removed and a detailed discussion on the affects that will have for each individual tree. (c) All approved tree pruning works must be carried out by a qualified Arborist, with a minimum Level 3 AQF in arboriculture and in accordance with WorkCover’s Code of Practice – Amenity Tree Industry. (d) Any pruning works carried out under this consent must not result in the death of the tree, the creation of a hazard or in excessive or inappropriate amounts of pruning, which result in the overall shape of the tree becoming unbalanced and/or unstable. (e) The consent from Council’s Tree Management Officer must be obtained prior to the undertaking of any additional tree pruning works or pruning of any tree roots greater than 40mm in diameter.
Tree Pruning. Tree pruning is not a part of this contract. Pruning should only be done adjacent to slash piles where a risk of fire spreading from the slash pile to adjacent live trees exists, or for other safety reasons. If pruning is necessary a variable random approach is required for example: prune the first tree to 4 ft., the next at 8ft, the next at 5ft and the next 10 feet, etc. This will insure a lack of uniformity amongst leave trees.
Tree Pruning. The PMSA shall trim all tree limbs that are damaged, unsightly, or that present unsafe conditions, and remove all debris. Also included is the trimming of all limbs within six (6) feet of any electric line, telephone line or line-of- sight for vehicular traffic, all limbs which hang below seventeen (17) feet over surfaced areas, and all limbs which overhang or touch a building or structure. All tree pruning shall be approved by a certified arborist.
