Tree Replacement. Any existing pepper tree, ▇▇▇▇▇ ▇▇▇▇▇▇ (lagerstroemia indica “watermelon red” and redbud (cercis occidentalis) that is permanently damaged or shows declining health, not due to lack of water or maintenance, shall be replaced with 48” box specimen tree, or as directed by County. Notify County of need for replacement and to obtain authorization.

Tree Replacement. The Developer, their assigns, or successors in interest, shall submit a tree removal and replacement plan with any building permit application for the Subject Property. The plan shall show the location of Landmark Trees, as defined in the Municipal Code, within 30 feet of the limits of construction and the construction access drive and identify any Landmark Trees that will be removed. This includes trees within the right-of-way that will be impacted or removed. The plan shall show the proposed replacement trees and their locations. Replacement trees are required at a ratio of one (1) replacement tree for each Landmark Tree removed. A surety will be required for the replacement trees prior to the issuance of a building permit.

Tree Replacement. The grantee should be prepared to fully replace all trees that are in poor condition or die prior to the end of the project grant agreement, unless loss is due to natural disaster beyond the control of the project manager or is allowed for in the grant narrative. If the plan allows for some tree mortality within the establishment period, the grant narrative should include a target survival rate, tree replacement would occur below that rate. Describe tree replacement plans. The restoration contractor will be required to include a warranty for replacement of planted trees due to poor condition or mortality for the duration of the project period. The warranty will require a 75% survival guarantee; below this survival rate, trees that are in poor condition or that have died will be replaced by the restoration contractor.

Tree Replacement a. The Proposer shall, at the direction of the City PM, remove and replace any tree within its establishment period that is missing, dies, or in the opinion of the City PM, is in an unhealthy or unsightly condition, and/or has lost its natural shape due to dead branches or decline, and/or 25% or more of the crown is in decline. All missing, dead, and rejected trees shall be removed within five (5) working days of notification by the City PM, unless directed otherwise by the City PM. Replacement trees shall be planted within the current or next appropriate planting season (October 15 – March 31), as determined by the City PM. b. All replacement trees planted under this contract shall be procured and planted by the Proposer at no additional cost to the City. c. All costs incurred in the removal and replacement of missing, dead, and rejected trees shall be borne by the Proposer. New trees, materials, etc., and planting procedures shall comply with the requirements specified herein. d. The species, cultivar, and size of the replacement tree shall be approved at the discretion of the City PM before the Proposer procures the tree. The City PM may require the replacement tree to be of different species, cultivar, or size. e. A tree shall not be replaced more than twice. f. When a tree becomes missing, dead, or rejected, the establishment cycle and payment stop. The establishment payments resume after the replacement tree is planted. A tree and its replacement(s) shall not receive, in total, more than the originally assigned years of establishment payments (3 or 4 years). Replacement trees are subject to a new establishment period (3 or 4 years). All establishment responsibilities end after the final acceptance, or at the completion of the contract, whichever comes first.

Tree Replacement. All trees permanently damaged, by any means, will be replaced with the identical species of tree existing previously, unless otherwise notified, in writing, by the PA. Size of the replacement shall be of like size. The need for and the size of replacement will be determined by the PA.

Tree Replacement a. At the direction of CITY, CONTRACTOR shall remove dead or damaged trees and replace the same with trees of equivalent size and variety up to 15 gallons when such death or damage is caused by any source other than major vandalism where the cost of replacement materials exceeds five hundred dollars ($500) before mark-up. b. CONTRACTOR shall be responsible for up to five hundred dollars ($500) of materials before mark-up and all labor costs for the repair or replacement of any trees damaged as a result of vandalism. c. CONTRACTOR is responsible for providing labor and equipment to plant all replacement trees. d. If, in the sole opinion of CITY’s Certified Arborist, tree failure is attributed to CONTRACTOR’s negligence, CONTRACTOR shall replace the failed tree with a similar tree of like size, up to 24” box specimen.
