Unprotected Service Clause Samples

The Unprotected Service clause defines a service or activity that is not covered by certain protections, warranties, or liabilities typically provided in a contract. In practice, this clause may specify that if a party uses a service outside the agreed scope, or in a manner not authorized by the contract, the provider is not responsible for any resulting damages or issues. This clause serves to limit the provider's liability and clarify the boundaries of their obligations, ensuring that risks associated with unauthorized or unsupported use are clearly allocated.
Unprotected Service an Ethernet or IP Transit service which does not include a protection scheme that allows traffic to be rerouted in the event of a fiber cut or equipment failure. Any Service not expressly designated as a Protected Service on the applicable Service Order shall be deemed an Unprotected Service.
Unprotected Service. An Unprotected Service is considered to have Chronic Trouble if it experiences three (3) or more Service Outages of more than twelve (12) hours each or for more than forty-two (42) or more aggregate cumulative hours during any calendar month, and the Service Outages did not result from any one or more of the occurrences set forth in Section 1.4 above.

  • Contracted Services In a fixed price contract, if the number of services provided is less than the number of services for which the Contractor received compensation, funds to be returned to the ADHS shall be determined by the Contract price. Where the price is determined by cost per unit of service or material, the funds to be returned shall be determined by multiplying the unit of service cost by the number of services the Contractor did not provide during the Contract term. Where the price for a deliverable is fixed, but the deliverable has not been completed, the Contractor shall be paid a pro rata portion of the completed deliverable. In a cost reimbursement contract, the ADHS shall pay for any costs that the Contractor can document as having been paid by the Contractor and approved by ADHS. In addition, the Contractor will be paid its reasonable actual costs for work in progress as determined by Generally Accepted Accounting Procedures up to the date of contract termination.

  • Service Animals Humber Residence acknowledges the rights of persons with disabilities to retain their service animal while living in Residence.
