The "Use by Owner" clause defines the rights and limitations regarding how the owner may use the work, property, or materials provided under the agreement. Typically, this clause outlines whether the owner can utilize the deliverables for personal, commercial, or other specified purposes, and may set boundaries on modifications, sublicensing, or sharing with third parties. Its core function is to clarify the scope of the owner's usage rights, thereby preventing disputes over unauthorized or unintended uses.
Use by Owner. Owner has the right to make advance reservations for the use of the Unit by Owner or Owner’s family members and friends, provided that these reservations have been accepted and confirmed by Agent. Agent shall have the right to book the Unit on any other date. Agent is not obligated to make Owner’s Unit available to the Owner when the Unit has already been reserved for a guest. Owner agrees to honor any reservations made for the Unit prior to Owner’s purchase of the Unit. Owner agrees not to enter the Unit and not to permit any other persons, including family members, friends, repairman, or guests, to enter the Unit without prior notification to, approval of, and coordination through Agent's office. Owner agrees to register at Agent's front desk before entering the Unit and upon check-out and agrees to have family members, friends and all other persons register prior to entering, and upon leaving, the Unit.
Use by Owner. A. The Owner reserves the right to let other contracts in connection with this Project or in connection with existing buildings. This Contractor shall afford other contractors reasonable opportunity for the introduction and storage of their materials and execution of their work.
B. The Owner reserves the right to jointly occupy the premises with the Contractor in the performance of his duties and functions. Contractor shall coordinate work with the Owner and cooperate with the Owner to minimize undue interference.
C. If any part or the entire Project is substantially complete or ready for use, the Owner may, upon notice to the Contractor, and without prejudice to any of the rights of the Owner or Contractors, enter into and make use of the work that is substantially complete.
Use by Owner. OWNER, family, and personal guests will be allowed to use the property at any time if no prior reservation by the Property Manager has been made and OWNER requests and obtains confirmation of a reservation for the period in question through the Property Manager. OWNER will be charged the appropriate cleaning fee unless prior payment arrangements are made with the Property Manager. OWNER assumes all liabilities associated with personal use of the property by OWNER or OWNER’S personal guests. OWNER and OWNER’S personal guests agree to observe the standard check- in and check-out times unless arrangements are made prior to arrival through the Property Manager. OWNER may not advertise to personally reserve the home for any paid rental guests. All paid guests must follow the reservation process through the Property Manager.
Use by Owner. Owners shall have the right to use the Unit he/she has purchased or other Units in the Hotel Condominium Project upon the following terms and conditions:
Use by Owner. Owner may, with Contractor’s consent, occupy or use any complete or partially completed portion of the Work at any stage, provided such occupancy or use is approved by the builder’s all risk and property insurer and provided such occupancy or use is in compliance with Law and is for the purpose that such portion of the Work was intended. If the parties agree to such partial occupancy or use prior to Substantial Completion, Owner assumes the complete risk of loss and damage of such completed or partially completed portion of the Work irrespective of the cause of such loss or damage, and Owner shall be deemed to have accepted such work and Substantial Completion of said portion of the Work shall be deemed to have occurred. Consent of Contractor to partial occupancy or use shall not be unreasonably withheld or delayed.
Use by Owner. Any use of the Unit by the Owner pursuant to this Article 7 will be strictly for the private purposes of the Owner or the Owner’s non-paying guests, who will be subject to all the rights and obligations of the Owner under this Article 7. Under no circumstances will the Owner during the Term directly or indirectly charge rent or accept any form of consideration for the use of the Unit except in accordance with the Rental Program and this Agreement.
Use by Owner. Owner shall be entitled to and Cape Fear Coastal Aviation agrees to provide the Aircraft to Owner for its use on a priority basis. Cape Fear Coastal Aviation agrees to make Aircraft available to Owner at Wilmington International Airport (KILM), located in Wilmington, NC. Cape Fear Coastal Aviation is not responsible for the agreed upon rental cost while the Aircraft is being ferried for the Owner’s use, or while the Aircraft is being used by the Owner. The Owner agrees to pay Cape Fear Coastal Aviation its per hour pilot services and fuel costs to ferry the Aircraft for Owner, or to provide pilot services to the Owner.
3.05.1 No other flight instruction. Owner shall provide this Aircraft to Cape Fear Coastal Aviation for rental free of any restrictions except those contained in this Agreement. Additionally, regarding the Owner’s use, the Owner agrees that the Aircraft will not be used for flight instruction with any other company besides Cape Fear Coastal Aviation.
Use by Owner. Subject to Contractor's consent, Owner may occupy or use any complete or partially completed portion of the Facilities at any stage, provided such occupancy or use is approved by the builders' all risk and property insurer (unless the risk management departments of both Owner and Contractor confirm that such approval is not necessary) and provided such occupancy or use (i) does not interfere with the Project Schedule, and (ii) is in compliance with Law and is for the purpose that such portion of the Facilities was intended. In the event of partial occupancy or use prior to Substantial Completion, Owner and Contractor shall amend this Agreement to allocate to Owner the care, custody, control and risk of loss and damage of such completed or partially completed portion of the Facilities, to the extent reasonably required in connection with the nature of the Facilities Owner elects to partially occupy.
Use by Owner. Subject to the terms of Section 1.5 of Exhibit G, Owner may, with Contractor's consent, occupy or use any complete or partially completed portion of the Work at any stage, provided such occupancy or use is approved by the builders-all-risk and property insurer (unless the risk management departments of both Owner and Contractor confirm that such approval is not necessary) and provided such occupancy or use is in compliance with Law and is for the purpose that such portion of the Work was intended. Such partial occupancy or use may commence prior to Substantial Completion only if Owner and Contractor have agreed in writing to any Changes to this Agreement necessitated by such use, including Changes with respect to the risk of loss and damage of such completed or partially completed portion of the Work and changes with respect to acceptance of such Work by Owner. Consent of Contractor to partial occupancy or use shall not be unreasonably withheld or delayed.
Use by Owner. OWNER’S account will be charged the appropriate cleaning fee unless prior payment arrangements are made with MANAGER. Security deposits are not charged to OWNER or OWNER’s personal guests. OWNER assumes all liabilities associated with personal use of the property by OWNER or OWNER’S personal guests. OWNER and OWNER’S personal guests agree to observe the standard check-in and check-out times unless arrangements are made prior to arrival through the MANAGER. OWNER may not advertise to personally reserve the home for any paid rental guests. All paid guests must follow the reservation process through MANAGER.
