Vehicle Fleet Size. 8.01 The Licensee shall have a minimum Fleet Size of 250 Vehicles at the time of application for this Agreement. 8.02 The City reserves the right to: (a) Set or adjust a maximum Fleet Size; (b) Set or adjust a minimum Fleet Size; and (c) Approve or disapprove a request for change in Fleet Size. 8.03 Should the Licensee require a change in Fleet Size greater than or equal to 100 Vehicles (including changing the minimum Fleet Size to zero on a seasonal basis), the Licensee may request from the City such changes in Fleet Size on a quarterly basis in advance as follows: (a) Quarter 1 (January 1 to March 31): The Licensee shall submit a Fleet Size update application to the City for Quarter 1 by December 10 in each year of the Term; (b) Quarter 2 (April 1 to June 30): The Licensee shall submit a Fleet Size update application to the City for Quarter 2 by March 10 in each year of the Term; and (c) Quarter 3 (July 1 to September 30): The Licensee shall submit a Fleet Size update application to the City for Quarter 3 by June 10 in each year of the Term. Vehicle Fleet Size a. A maximum total of 5,000 electric-assisted bicycles will be authorized by the City under the Ordinance among all licensees. b. Up to 1,500 electric-assisted bicycles with a minimum of 1,250 electric- assisted bicycles must be made available for public use no later than thirty (30) days after initial deployment, and deployment of bicycles must begin within seven (7) days of April 3, 2024, unless otherwise notified by the City. Licensee must have full allotment of electric-assisted bicycles in the market no later than thirty (30) days after initial deployment, and available to deploy to meet demand. Starting on November 15th, 2024, unless otherwise notified by the City, Licensee may reduce their fleet below 1250 electric-assisted bicycles without penalty in preparation for the end of the season. c. A maximum total of 3,000 motorized foot scooters will be authorized by the City under the Ordinance among all licensees. d. Deployment of scooters must begin within seven (7) days of April 3, 2024 unless otherwise notified by the City. Licensee must have up to 900 with a minimum of 650 motorized foot scooters available for public use no later than 30 days after initial deployment. e. If any Licensee declines to use their full initial deployment of electric assisted bicycles or motorized foot scooters, the City reserves the right to redistribute the remaining vehicles to another Licensee. f. Availability to the public will be defined by the number of scooters available to rent in the public right of way. including a +/- 5% variance for unaccounted vehicles in use. g. If at any point during the license period the Licensee's fleet drops below their initial deployment level, including a +/- 10% variance for unaccounted vehicles in use, a penalty will be assessed as outlined in the Parking and Mobility Services Fee and Rate Schedule. Starting on November 15th, 2024, unless otherwise notified by the City, Licensee may reduce their fleet below the initial deployment level of motorized foot scooters without penalty in preparation for the end of the season. h. Vehicle Fleet Size. The number of vehicles required in the LYMMO fleet are a function of the vehicles required during the AM and PM peak periods, plus maintenance spares. A 20% spare ratio is proposed for LYMMO, with a minimum of three spare buses. The year 2016 service plan will require a fleet of 14 buses based on a peak requirement of 11 buses plus three (3) maintenance spares.

The City will hold compliance meetings as defined by Section 3(a) with Licensee to review compliance and utilization data. o If at each meeting, the Licensee demonstrates compliance, as defined in Section 3(a), and the average rides per scooter per day is greater than or equal to three (3) in the previous compliance period, then Licensee shall make an additional 250 scooters available for public use within fourteen (14) days of the meeting until the maximum allotment is reached. If a fleet increase has previously been granted and the average rides per scooter per day is less than two (2) in the previous compliance period, then Licensee shall reduce the number of scooters available for public use by 125 within seven (7) days of the meeting. Fleet size will never decrease below 500 and increases will be available until the maximum total, as defined in 1(a) is attained. d. Utilization rates will be evaluated by the City at each compliance meeting and may be increased or decreased by the City. e. Licensee shall notify the City when reducing the number of fleet vehicles available for public use due to weather or emergency situations.
