Vesting of Powers Sample Clauses

Vesting of Powers. Upon any successor Domiciliary Agent appointed hereunder executing, acknowledging and delivering to the Issuer and the Trustee an instrument accepting such appointment hereunder, it shall, without any further act, deed or conveyance, become vested with all authority, rights, powers, trusts, indemnities, duties and obligations of the Domiciliary Agent hereunder.

Vesting of Powers. Upon any successor account bank appointed hereunder executing, acknowledging and delivering to the Issuer and the Note Trustee an instrument accepting such appointment hereunder, it shall, without any further act, deed or conveyance, become vested with all authority, rights, powers, trusts, indemnities, duties and obligations of the Account Bank hereunder.

Vesting of Powers on the Board In the event of a share capital increase, the General Meeting may vest on the Board the powers set out in the Public Companies Act.

Vesting of Powers in Successor Whenever the conditions of section 11.1 have been duly observed and performed, the Trustee and, if required by section 11.1, JDS Uniphase Successor and Exchangeco shall execute and deliver the supplemental trust agreement provided for in Article 12 and thereupon JDS Uniphase Successor shall possess and from time to time may exercise each and every right and power of JDS Uniphase under this trust agreement in the name of JDS Uniphase or otherwise and any act or proceeding by any provision of this trust agreement required to be done or performed by the Board of Directors of JDS Uniphase or any officers of JDS Uniphase may be done and performed with like force and effect by the directors or officers of such JDS Uniphase Successor.
