Virtual Collocation. (a) If Requesting Carrier requests Virtual Collocation, or if requested Physical Collocation space is not available at a Premises and Requesting Carrier elects Virtual Collocation, and such Virtual Collocation is available at the time of Requesting Carrier's request, Ameritech shall include in its notice to Requesting Carrier described in Section 12.12.1 (i) the space to be provided and (ii) whether Ameritech can deliver the space to Requesting Carrier by the date set forth in Section 12.12.3(c). (b) Ameritech and Requesting Carrier will have an initial walkthrough of the Collocated space to be provided to Requesting Carrier for Virtual Collocation on the earlier of (i) ten (10) Business Days after Ameritech's verification of the Virtual Collocation space to be provided to Requesting Carrier and (ii) fourteen (14) days after Ameritech's receipt of Requesting Carrier's request for Virtual Collocation. Ameritech shall within ten (10) Business Days after such walkthrough provide Requesting Carrier with documentation submitted to and received from contractors for any work being done on behalf of Requesting Carrier that will be billed as extraordinary expenses. (c) Ameritech shall deliver to Requesting Carrier the requested space on or before the later of (i) twelve (12) weeks from Ameritech's receipt of Requesting Carrier's request for Virtual Collocation and (ii) such other reasonable date that the Parties may agree upon if it is not feasible for Ameritech to deliver to Requesting Carrier such space within twelve (12) weeks (such date of delivery referred to as the “Delivery Date”) and Ameritech notified Requesting Carrier of this fact within ten (10) Business Days after the initial walkthrough. (d) Virtual Collocation space ordered by Requesting Carrier will be made available to Requesting Carrier by Ameritech, as more fully described in Section 3 of Schedule 12.12. (e) After completion of construction, Requesting Carrier and Ameritech will complete an acceptance walkthrough of all Collocation space requested from Ameritech. Exceptions that are noted during this acceptance walkthrough shall be corrected by Ameritech within thirty (30) days after the walkthrough. Virtual Collocation. 8.6.1.1 Maintenance Labor, Inspector Labor, Engineering Labor and Equipment Labor business hours are considered to be Monday through Friday, 8:00 am to 5:00 pm (local time) and after business hours are after 5:00 pm and before 8:00 am (local time), Monday through Friday, all day Saturday, Sunday and holidays.
Virtual Collocation. Upon request, Ameritech shall provide Requesting Carrier Virtual Collocation in any Unused Space. If Requesting Carrier wishes to Virtually Collocate a bay other than a Standard Bay, it must request such Virtual Collocation via an NSCR. Requesting Carrier shall not have physical access to its Virtually Collocated equipment but may, at its expense, electronically monitor and control its Virtually Collocated equipment. Ameritech shall, subject to Requesting Carrier’s payment of the applicable rates, fees and charges, be responsible for installing, maintaining and repairing Requesting Carrier’s equipment. Requesting Carrier cannot convert its Virtually Collocated equipment “in-place” to a method of Physical Collocation available hereunder (e.g., no “in-place” conversion of Virtual Collocation to Cageless Physical Collocation). In addition to the rates set forth in Item VII of the Pricing Schedule, if Ameritech must locate Requesting Carrier’s Virtual Collocation bays in its switch line-up, Requesting Carrier shall also be responsible for any extraordinary costs necessary to condition such space.
Virtual Collocation. (a) If CLEC requests Virtual Collocation, or if requested Physical Collocation space is not available at a Premises and CLEC elects Virtual Collocation, and such Virtual Collocation is available at the time of CLEC's request, SBC-AMERITECH shall include in its notice to CLEC described in Section 12.15.1: (i) the space to be provided, and (ii) whether SBC-AMERITECH can deliver the space to CLEC by the date set forth in Section 12.15.5(c). (b) SBC-AMERITECH and CLEC will have an initial walkthrough of the Collocated space to be provided to CLEC for Virtual Collocation on the earlier of: (i) ten (10) Business Days of SBC-AMERITECH's verification of the Virtual Collocation space to be provided to CLEC, and (ii) fourteen (14) calendar days after SBC-AMERITECH's receipt of CLEC's request for Virtual Collocation. SBC-AMERITECH shall within ten (10) Business Days after such walkthrough provide CLEC with: (i) documentation submitted to and received from contractors for any work being done on behalf of CLEC that will be billed as extraordinary expenses, and (ii) a parallel installation sequence. (c) SBC-AMERITECH shall deliver to CLEC the requested space on or before the later of: (i) twelve (12) weeks from SBC-AMERITECH's receipt of CLEC's request for Virtual Collocation, and (ii) such other reasonable date that the Parties may agree upon if it is not feasible for SBC-AMERITECH to deliver to CLEC such space within twelve (12) weeks (such date of delivery referred to as the “Delivery Date”) and SBC-AMERITECH has notified CLEC of this fact within ten (10) Business Days from SBC-AMERITECH's receipt of CLEC's request. (d) Virtual Collocation space ordered by CLEC will be made available to CLEC by SBC-AMERITECH, as more fully described in the Schedules 12.12 and 12.15. (e) SBC-AMERITECH shall provide positive confirmation to CLEC when construction of CLEC-Collocated space is fifty percent (50%) completed. This confirmation shall also include confirmation of the scheduled completion date and the Delivery Date. The Implementation Plan will include a process for determining when construction is fifty percent (50%) complete. (f) After completion of construction, CLEC and SBC-AMERITECH will complete an acceptance walkthrough of all collocated space requested from SBC-AMERITECH. (b) Ameritech shall deliver to Requesting Carrier the requested space on or before the later of (i) twelve (12) weeks from Ameritech’s receipt of Requesting Carrier’s Collo Order for Virtual Collocation and (ii) such other reasonable date that the Parties may agree upon if it is not feasible for Ameritech to deliver to Requesting Carrier such space within twelve (12) weeks (such date of delivery referred to as the “Delivery Date”) and Ameritech notified Requesting Carrier of this fact within ten (10) Business Days after the initial walk-through. (c) Virtual Collocation space ordered by Requesting Carrier will be made available to Requesting Carrier by Ameritech, as more fully described in Section 3 of Schedule 12.12. Virtual Collocation. Subject to Section 1 of this Article IX, GTE will provide virtual collocation for purposes of interconnection or access to unbundled network elements pursuant to the terms and conditions in the applicable GTE federal and state EIS tariffs. In addition, GTE agrees that the terms and conditions set forth in this Section 2 of this Article IX, shall apply to virtual collocation provided to DTI.
Virtual Collocation. 7.2.1 USWC shall provide Virtual Collocation for the purpose of Interconnection or access to unbundled Network Elements subject to the rates, terms and conditions of this Agreement. 7.2.2 Teligent will not have physical access to the USWC wire center building pursuant to a Virtual Collocation arrangement other than for the purpose of accessing the SPOT frame.. USWC will not provide access for Teligent to the collocated equipment for a Virtual Collocation arrangement. 7.2.3 Teligent will be responsible for obtaining and providing to USWC administrative codes, e.g., common language codes, for all equipment specified by Teligent and installed in Wire Center buildings. 7.2.4 Teligent will be responsible for payment of training of USWC employees for the maintenance, operation and installation of Teligent’s virtually collocated equipment when that equipment is different than the equipment used by USWC. 7.2.5 Teligent will be responsible for payment of charges incurred in the maintenance and/or repair of Teligent’s virtually collocated equipment. 7.2.6 USWC does not guarantee the reliability of Teligent’s virtually collocated equipment, but USWC is responsible for proper installation, maintenance and repair of such equipment, including the change out of electronic cards provided by Teligent. 7.2.7 Teligent is responsible for ensuring the functionality of virtually collocated SONET equipment provided by different manufacturers. 7.2.8 Maintenance Labor, Inspector Labor, Engineering Labor and Equipment Labor business hours are considered to be Monday through Friday, 8:00am to 5:00pm (local time) and after business hours are after 5:00pm and before 8:00am (local time), Monday through Friday, all day Saturday, Sunday and holidays. 7.2.9 Teligent will transfer possession of Teligent’s virtually collocated equipment to USWC via a no cost lease. Title to the Teligent virtually collocated equipment shall not pass to USWC. 7.2.10 Installation and maintenance of Teligent’s virtually collocated equipment will be performed by USWC or a USWC authorized vendor. 7.2.11 Teligent shall ensure that upon receipt of the Teligent virtually collocated equipment by USWC, all warranties and access to ongoing technical support are passed through to USWC, all at Teligent’s expense. Virtual Collocation. Virtual Collocation will be made available according to the terms and conditions described in BellSouth’s FCC Tariff No. 1 for all states except Florida, which will be made available pursuant to the terms and conditions contained in the Florida Access Services Tariff. BellSouth shall provide Virtual Collocation at the rates set forth in Exhibit B. If there are any inconsistencies between BellSouth’s FCC Tariff No. 1 or the Florida Access Services Tariff, and this Agreement, the rates, terms, and conditions of this Agreement shall control. 3.7.1 Virtual Collocation would occur when TelCove provides and leases to BellSouth its transmission and other collocation equipment dedicated to TelCove’s use. TelCove will be responsible for monitoring and controlling TelCove’s circuits terminating at BellSouth’s Premises. Once space preparation is complete, and upon TelCove’s request, TelCove shall contract with a BellSouth Certified Supplier to install all equipment and facilities in accordance with BellSouth’s guidelines and Specifications. TelCove shall be responsible for all costs of the BellSouth Certified Supplier’s installation of TelCove’s virtual collocation arrangement. TelCove shall be responsible for all engineering associated with the installation and the provision of the equipment, necessary supplies and related documentation related to provisioning TelCove’s virtual collocation space. BellSouth will maintain and repair such equipment under the same intervals and with the same or better failure rates for performance of similar functions for comparable BellSouth equipment. Maintenance may include the change out of electronic cards provided by TelCove. 3.7.2 TelCove may purchase the equipment from a third party, and is not required to purchase the equipment from BellSouth. 3.7.3 BellSouth will make available digital, analog and fiber cross connects for Virtual Collocation at the rates contained in Exhibit B.
