Existing Virtual Collocation Clause Samples

The Existing Virtual Collocation clause defines the terms and conditions under which parties may continue to use or maintain virtual collocation arrangements that were established prior to the current agreement. Typically, this clause outlines the rights and obligations regarding the use of existing equipment, access to facilities, and any limitations on modifications or upgrades. Its core practical function is to ensure continuity and stability for services or infrastructure already in place, preventing disruption and clarifying responsibilities for legacy virtual collocation setups.
Existing Virtual Collocation. If, on the effective date of this Agreement, DTI is virtually collocated in a GTE premise, DTI may (I) elect to retain its virtual collocation arrangement in that premise or (ii) unless it is not practical for technical reasons or because of space limitations, convert its virtual collocation arrangement at that premise to physical collocation. If DTI elects the latter option, DTI's request shall be treated as a new physical collocation request and DTI shall pay GTE at the applicable tariff rates for construction and rearrangement of DTI's equipment as well as all applicable tariffed physical collocation recurring charges.
Existing Virtual Collocation. If, on the effective date of this Agreement, Cellular One is virtually collocated in a GTE premise, Cellular One may (i) elect to retain its virtual collocation arrangement in that premise or (ii) unless it is not practical for technical reasons or because of space limitations, convert its virtual collocation arrangement at that premise to physical collocation. If Cellular One elects the latter option, Cellular One=s request shall be treated as a new physical collocation request and Cellular One shall pay GTE at the applicable tariff rates for construction and rearrangement of Cellular One=s equipment as well as all applicable tariffed physical collocation recurring charges.
Existing Virtual Collocation. If, on the effective date of this Agreement, SETI is virtually collocated in a GTE premise, SETI may (i) elect to retain its virtual collocation arrangement in that premise or (ii) unless it is not practical for technical reasons or because of space limitations, convert its virtual collocation arrangement at that premise to physical collocation. If SETI elects the latter option, SETI's request shall be treated as a new physical collocation request and SETI shall pay GTE at the applicable tariff rates for construction and rearrangement of SETI's equipment as well as all applicable tariffed physical collocation recurring charges.
Existing Virtual Collocation. If, on the effective date of this Agreement, Hyperion is virtually collocated in a GTE premise, Hyperion may (i) elect to retain its virtual collocation arrangement in that premise or (ii) unless it is not practical for technical reasons or because of space limitations, convert its virtual collocation arrangement at that premise to physical collocation. If Hyperion elects the latter option, Hyperion’s request shall be treated as a new physical collocation request and Hyperion shall pay GTE at the applicable tariff rates for construction and rearrangement of Hyperion’s equipment as well as all applicable tariffed physical collocation recurring charges.

If QTC elects the latter option, QTC's request shall be treated as a new physical collocation request and QTC shall pay GTE at the applicable tariff rates for construction and rearrangement of QTC's equipment as well as all applicable tariffed physical collocation recurring charges.

If NT elects the latter option, NT's request shall be treated as a new physical collocation request and NT shall pay GTE at the applicable tariff rates for construction and rearrangement of NT's equipment as well as all applicable tariffed physical collocation recurring charges.

If Mobilnet elects the latter option, Mobilnet’s request shall be treated as a new physical collocation request and Mobilnet shall pay GTE at the applicable tariff rates for construction and rearrangement of Mobilnet’s equipment as well as all applicable tariffed physical collocation recurring charges.
Existing Virtual Collocation. If, on the effective date of this Agreement, Vanguard is virtually collocated in a GTE premise, Vanguard may (i) elect to retain its virtual collocation arrangement in that premise or (ii) unless it is not practical for technical reasons or because of space limitations, convert its virtual collocation arrangement at that premise to physical collocation. If Vanguard elects the latter option, Vanguard=s request shall be treated as a new physical collocation request and Vanguard shall pay GTE at the applicable tariff rates for construction and rearrangement of Vanguard=s equipment as well as all applicable tariffed physical collocation recurring charges.
Existing Virtual Collocation. If, on the effective date of this Agreement, Centennial is virtually collocated in a GTE premise, Centennial may (i) elect to retain its virtual collocation arrangement in that premise or (ii) unless it is not practical for technical reasons or because of space limitations, convert its virtual collocation arrangement at that premise to physical collocation. If Centennial elects the latter option, Centennial’s request shall be treated as a new physical collocation request and Centennial shall pay GTE at the applicable tariff rates for construction and rearrangement of Centennial’s equipment as well as all applicable tariffed physical collocation recurring charges.
Existing Virtual Collocation. If, on the effective date of this Agreement, Tallgrass is virtually collocated in a GTE premise, Tallgrass may (I) elect to retain its virtual collocation arrangement in that premise or (ii) unless it is not practical for technical reasons or because of space limitations, convert its virtual collocation arrangement at that premise to physical collocation. If Tallgrass elects the latter option, Tallgrass's request shall be treated as a new physical collocation request and Tallgrass shall pay GTE at the applicable tariff rates for construction and rearrangement of Tallgrass's equipment as well as all applicable tariffed physical collocation recurring charges.
