Where the Service. PROVIDER has consented to the placing of sub- contracts, copies of each sub-contract shall, at the request of the AUTHORITY/Contracting AUTHORITY, be sent by the SERVICE PROVIDER to the AUTHORITY/Contracting AUTHORITY as soon as reasonably practicable.
Where the Service. Provider invokes the provisions of this Clause after the due date of a disputed invoice, then the Service Provider shall not be entitled to withhold any portion of the amount due and payable. The Service Provider shall be entitled to raise a billing dispute within twenty-four (24) months of the end of the disputed billing period.
Where the Service. Provider agrees to deliver Natural Gas at a delivery rate in excess of the Maximum Customer Delivery Rate and fails to deliver Natural Gas at such excess rate, the Shortfall Quantity shall be determined on an Hourly basis and shall be calculated for the Nomination Period, as the sum of for each Hour within such Nomination Period, the difference between: (a) the aggregate rate agreed to by the Service Provider; and (b) the actual rate at which Natural Gas was delivered.
Where the Service. Provider enters into a Sub-Contract, the Service Provider shall include in that Sub-Contract:‌ 23.4.1. provisions having the same effect as Conditions 7.4 to 7.6 of this DPS Agreement; and‌ 23.4.2. a provision requiring the counterparty to that Sub-Contract to include in any Sub-Contract which it awards provisions having the same effect as Conditions 7.4 to 7.6 and this Condition 23.4.‌‌
Where the Service provided pursuant to Article 1 of this Agreement is subject to value added tax (VAT), the above net amount (Article 2.1 and Annex 1) shall be grossed up to include applicable VAT, provided however, that the invoice must properly state the VAT amount due. Consultant shall be responsible for proper treatment and declaration of direct taxes with regard to invoiced and paid amounts.
Where the Service. Provider collects or acquires personal information directly from the individual it is about, the Service Provider shall ensure that the individual is informed of: (a) the purpose for which the personal information is collected; (b) how the information is to be used and disclosed; (c) the legal authority for the collection; (d) who can answer questions the individual may have about his or her personal information; and (e) the individual‘s right of access to the personal information about himself or herself, as set out in the Service Provider’s policies established in accordance with subsection 1.06 of this Appendix.
Where the Service. Manager is of the opinion, that any of the Contractor’s employees (or any subcontractors involved in Providing the Service) may be in possession of, have taken, or are under the influence of any Prohibited Substance while Providing the Service, the Service Manager instructs the Contractor to perform a drug and alcohol test using the following as appropriate of such Contractor employeesbreath testing by breathalyser, • urine testing by urinalysis and, • a search of personal possessions/ work area of such Contractor employees for evidence of a prohibited substance. 17.1 The Contractor adopts “charity-based incentive schemes” covering local and national charities if requested to do so by the Client.
Where the Service. Provider collects personal information directly from the individual the information is about, the Service Provider must tell that individual: (a) the purpose for collecting it; (b) the legal authority for collecting it; and (c) the name and contact information of the individual designated by CLBC to answer questions about the Service Provider’s collection of personal information.
Where the Service. Provider has appointed a Sub-Contractor, the Service Provider shall ensure that such Sub-Contractor is properly equipped, experienced, organised and financed to undertake the duties assigned to it and the Service Provider warrants that it will actively monitor the performance of such Sub- Contractor at all times.

  • Use of the Service 12.1 When using the Service you must comply with: (a) our CRA, including clause 4 of the General Terms, and this clause 12; and (b) any rules, including any acceptable use conditions, imposed by any third party whose content or services you access using the Service or whose Network on which your data transmits. 12.2 Any use of the Service at the Premises is your responsibility. The terms of our CRA apply to you and also to anyone else who uses the Service (regardless of whether you give them permission to do so or not). 12.3 You must ensure that any software you use in relation to the Service is properly licensed. 12.4 The use of a Local Area Network (LAN) for personal use is permitted, however the set-up and configuration of a LAN connected to the modem is not supported by customer service. 12.5 All IP addresses provided by us for your use remain our property. Most Services include a dynamic IP address. A new IP address is usually allocated whenever the computer and modem are rebooted. The IP address remains until the next time the computer and modem are switched off. Where provided, you may configure your computer or modem to connect using a static IP address. 12.6 We may at any time adjust aspects of the Service for security or Network management reasons, including, without limitation: (a) deleting transitory data that has been stored on our servers for longer than 90 days; (b) deleting stored email messages that are older than 90 days; (c) rejecting any incoming email messages and attachments that exceed 30 Megabytes (including encapsulation); (d) delivering access and content via proxy servers; (e) limiting the number of addresses to whom an outgoing email can be sent; (f) refusing to accept incoming email messages to mailboxes that have exceeded the email storage limit; (g) managing the Network to prioritise certain types of Internet traffic over others; and (h) blocking or filtering specific Internet ports. 12.7 You are responsible for providing any security or privacy measures for your computer networks and any data stored on those networks or accessed through the Service. We will not be liable to you in respect of any loss, damage, costs or expenses incurred by you in connection with your failure to provide that security. 12.8 You may request additional users on the Service in accordance with the Pricing Schedule. 12.9 You must take reasonable steps to ensure that others do not gain unauthorised access to the Service through your account. We recommend that you do not disclose your password to others and that you change your password regularly. 12.10 We may monitor use of the Service to investigate a breach (or suspected breach) of the Fair Use Policy or upon the request of an authorised authority. 12.11 Where you provide your own wireless computer connection device, you are responsible for any loss caused by an unauthorised interception of the Service.
