Work Capacity Testing Clause Samples
The Work Capacity Testing clause establishes the right of an employer to require employees to undergo assessments that determine their physical or mental ability to perform job duties. Typically, this clause applies when there are concerns about an employee’s fitness for work, such as after an injury, illness, or extended absence, and may involve medical evaluations or functional capacity tests. Its core function is to ensure workplace safety and productivity by verifying that employees are capable of safely fulfilling their roles, thereby reducing the risk of workplace accidents and managing potential liability.
