WORKING HOURS AND OVERTIME. 8.1 The normal working day shall be 8 consecutive hours exclusive of meal period. The normal work week shall be 40 hours. 8.1.1 The Company may, where required, institute 10-hour (exclusive of meal period)/4 day per week driver positions in accordance with Article 5.2. 8.2 Warehousepersons B shall be paid a minimum of 3 hours’ pay at the straight time rate, and if required to perform work beyond 3 hours shall be paid on the minute basis for work in excess of 3 hours. Lunch hour for employees holding City Tractor or Driver Representative positions will commence between the end of the third hour of the shift and the end of the sixth hour of the shift. This clause only applies to employees holding bulletin positions. 8.8 All employees working in excess of three (3) hours will receive a fifteen (15) minute paid coffee break. A fifteen (15) minute coffee break without loss of pay will commence after approximately two hours of work, or at or about the mid-point of the first half after an employee reports for duty. A second fifteen (15) minute paid coffee break shall be after six hours of work where the tour of duty is in excess of six hours. There will be a third paid15 minute break if 3 hours of overtime are completed. This break is to be taken after the second hour of overtime has been completed. These breaks shall not be cumulative. 8.9 Employees shall be allowed to elect to bank overtime in lieu of pay to maximum of 40 hours at the rate of one and one-half hours banked for every one hour worked. Overtime worked will automatically be used to replenish the bank to the maximum of 40 hours during the course of the year. Laid off employees will be allowed to withdraw banked time on days when no work is made available to them. 8.9.2 An employee off duty due to bona fide illness who is not claiming Short Term Disability Benefits payments will be permitted to use accumulated Banked Overtime as of the second day of their absence. 8.9.3 An employee off duty due to bone fide illness who is eligible to receive Short Term Disability benefit payments will be permitted to use accumulated Banked Overtime to offset the three- day waiting period required by the STD plan. 8.9.4 When a request to use Banked Overtime is granted, it will not be withdrawn after approval unless otherwise agreed by the employee and the supervisor. 8.9.5 Banked Overtime may be used in the event of a shortage of work occurs and the Company asks for volunteers to take a day off. Should the employee wish to use an annual vacation day or Banked Overtime Day to compensate for the days lost earnings, their request will not be denied.

Any balance of banked overtime unused pay will be carried determined by the regular crew overtime. (Make-up day may not be utilized on an individual Employees basis or to make up holidays).
(f) If the Contractor elects Option 2, all hours worked by the Employee in excess of ten (10) hours in any one day (exclusive of lunch period) or over to the next year unless the employee gives notice to withdraw from the program or requests to forty (40) hours in any one work week (Monday through Friday) shall be paid out any unused portion at the rate of one and one-half (1 ½) times the regular rate of pay. Friday shall be treated as indicated in 8.9.1.

WORKING HOURS AND OVERTIME. 8.1 4.01 The normal working day basic work week for regular full-time engineers shall be 8 consecutive thirty-six (36) hours exclusive divided between four (4) working days with a maximum in any one (1) day of meal period. The normal work week shall be 40 nine (9) hours.
8.1.1 4.02 The Company mayshall post annually the work schedule showing the starting times, where requireddays of work, institute 10-hour (exclusive and days of meal period)/4 day per week driver positions in accordance with Article 5.2rest.
8.2 Warehousepersons B 4.03 The work schedule shall be established by mutual agreement between the Employer and the Union and once established shall not be altered unless by mutual agreement between the Employer and the Union. It is understood and agreed that changes in production, lengthy sickness or compensable injury are examples that may alter the schedule.
4.04 The Company agrees to grant maintenance engineers two (2) consecutive days off each week; where possible they will be granted over the weekend (Friday to Monday) and where not possible a premium of thirty-five (35) cents per hour will be paid for all hours worked during that week.
4.05 When scheduling two (2) consecutive days off the Company will provide forty-eight (48) hours plus a minimum of 3 hours’ pay at eight (8) hours between shifts.
4.06 All time worked over thirty-six (36) hours in any one (1) week or over the straight time rate, and if required to perform work beyond 3 normal shift hours shall be paid on for at the minute basis for work in excess rate of 3 hours. Such work will be offered in order of length of Company service.

4.10 It is understood and agreed that no designated engineer shall be permitted to leave the plant or go off duty while steam is being drawn from the boiler, nor shall any one dayother work that may be assigned to them be allowed to interfere with the safe operation of the boiler and machinery.
4.11 Except in an emergency an engineer when changing shifts shall have twelve (12) hours off between shifts and receive forty-eight (48) hours’ notice of such change. Also, or 40 except in an emergency, the hours in any one week, as specified in Article 8.1.1 by which the time off between shifts is less than twelve (12) hours shall be paid for at one overtime rates. It is further agreed that changes in shifts shall be discussed by Management and one-half times the hourly rate employee concerned prior to such changes being made. The Company agrees prior to rescheduling of payan employee’s shift that consideration will be given to hiring additional help as an alternative. An emergency will be defined as a situation which would curtail production.
8.5 Employees4.12 The Company may schedule a lunch period of not more than thirty (30) minutes as near mid-shift as possible, if required to work where it is practical and in accordance with the Power Engineers’ Boiler and Pressure Vessel Safety Act and Regulations. Lunch periods will be taken on regularly the employee’s own time except where an Engineer has been assigned rest days, the responsibility of the boiler(s). In this instance the meal period shall be inclusive of hours of work. Interrupted lunch period shall be paid for at the rate of time and one-half time (1 ½) rescheduled later on in the actual minute basis with a minimum payment of 4 hours at the pro rata hourly rateshift.
8.6 Where work 4.13 All employees shall be given a ten (10) minute rest period approximately midway in each half- shift at a time to be designated by the Company in accordance with the requirements of the Company’s operation.
4.14 “Call-in” or “call-back” is required a request by the Company to be performed the employee to report to work other than for a scheduled shift. This would include call-in on a scheduled day which is off or prior to scheduled shift, or call-back after normal shift completed. Employee’s called-in or called-back shall receive not part of any assignment, it may less than four (4) hours’ pay and shall receive one (1) full days pay if working over four (4) hours and up to nine (9) hours at the appropriate overtime rate. Employees shall only be performed by an available extra or unassigned employee who will otherwise not have 40 required to perform work related to the call-in.

There will be a third paid15 minute break if 3 hours of overtime are completed. This break is to be taken after the second hour of overtime has been completed. These breaks shall not be cumulative.

8.9.4 When a request to use Banked Overtime is granted, it will not be withdrawn after approval unless otherwise agreed by the employee and the supervisor.
8.9.5 Banked Overtime may be used in the event of a shortage of work occurs and the Company asks for volunteers to take a day off. Should the employee wish to use an annual vacation day or Banked Overtime Day to compensate for the days lost earnings, their request will not be denied.
