Your Right to Cancel. If you are a “consumer” (an individual buying insurance wholly or mainly for purposes unrelated to their trade business of profession) then you usually have the legal right to cancel a policy within 14 days of receiving the full policy terms and conditions. This timescale may vary depending on the policy purchased but the terms will be explained in your policy documents. The Credit Contracts and Consumer Finance Act 2003 (if applicable) gives you right of a right consumer to cancel a policy does not apply: • If an incident has occurred within those 14 days, where a claim is or could be made, including by someone else; • To policies of less than one month in duration, such as short-term travel insurance. A charge may apply for the period of cover provided and, in addition, we may make an administration charge as detailed above. If You cancel a short time credit agreement You will need to repay any sums provided in full. You should contact us or the insurer direct as soon as you become aware of any incident which could give rise to a claim. Your insurer’s claims contact number is shown in Your policy documents. If you want do not tell your insurer of an incident that could give rise to cancel claim promptly, your insurer may refuse to deal with your claim or reduce the Agreement amount that you must give written notice to Westpac NZmay receive from them. Time limits for cancellation If the disclosure documents are: You must give notice that you intend to cancel within • handed to you directly 5 working days (from the date of the documents are • sent to you by electronic means (for example, e-mail) handed to you) • mailed to you, 7 working days (from sending date) • mailed to you, 9 working days (from posting date) Saturdays, Sundays, and national public holidays and the days in the period between 25 December and 2 January (inclusive) are not counted as working days for this purpose. What you may have to pay if you cancel If you cancel the Agreement Westpac NZ may charge you: • the amount of any reasonable expenses Westpac NZ had to pay in connection with the contract Agreement and its cancellation (including legal fees and fees for credit reports, etc.); and • interest interest, as provided for in the Agreement, for the period from the day you received the first advance until the day you repay the advance all advances in full as provided for in the Agreementfull. This statement only contains a summary of your rights and obligations in connection with the right to cancel. If there is anything about your rights or obligations under the Credit Contracts and Consumer Finance Act 2003 that you do not understand, if there is a dispute about your rights, or if you think that Westpac NZ is being unreasonable in any way, you should seek legal advice immediately. Unforeseen Hardship If you are in financial difficulty (for example, because of illness, injury, or loss of employment), it is important that you don’t ignore the problem. Contact us as soon as possible if you are having problems meeting your repayments or think that you may experience difficulty doing so in the near future. If the Agreement is a consumer credit contract for the purposes of the Credit Contracts and Consumer Finance Act 2003, depending on your circumstances you may be able to make a hardship application. There are limits on when and how often you can make a hardship application. If you’re still unhappy after we’ve reviewed your complaint, and the Agreement is a consumer credit contract for the purposes of the Credit Contracts and Consumer Finance Act 2003, then you may want to refer the matter to the Banking Ombudsman.
