▇▇▇▇▇▇▇ Use. No safety-sensitive employee should report for duty or remain on duty when his/her ability to perform assigned functions is adversely affected by alcohol or when his/her alcohol concentration is 0.04 or greater. No safety- sensitive employee shall use alcohol while performing safety-sensitive functions, within four hours of reporting for duty, or during the hours that they are on call. In order for the test to be done at the conclusion of a shift, the test must be done immediately, and the employee shall be paid for the time necessary to conduct the test which pay shall be for no less than 30 minutes.
▇▇▇▇▇▇▇ Use. The term of this Agreement for ▇▇▇▇▇▇’▇ use of the AbbVie Trademarks (the “Abbott Term”) shall be determined in accordance with the term of the relevant Ancillary Agreement(s) wherein Abbott has agreed to provide commercial services on behalf of AbbVie following Separation.
▇▇▇▇▇▇▇ Use. Your access to your Activity Reports is password protected. Activity Reports are provided to you in strictest confidence. Such Activity Reports shall not be disclosed by you to any third party or used for purposes other than in the performance of your obligations under the Agreement and for our benefit without our prior written consent. Any unauthorized use or disclosure of Activity Report constitutes misuse, misappropriation, and a violation of the Distributor Agreement and may cause irreparable harm to us.
▇▇▇▇▇▇▇ Use. An employee will be considered to have failed (with a test result of 0.04 percent or greater) an administered evidential breath alcohol test administered by a certified breath alcohol technician. To be considered a confirming evidential test, a breath alcohol technician must have administered a preliminary (screening) breath test within the 30 minute period immediately preceding the evidential test. The preliminary test must have resulted in a reading of not less than 0.02 percent to warrant the evidential breath test.
▇▇▇▇▇▇▇ Use. Notwithstanding the rights granted to the City herein, ▇▇▇▇▇▇’▇, its affiliates, and its and their directors, managers, employees, agents, contractors and visitors maintain the right to use the Parking Facility for parking or other business purposes.
▇▇▇▇▇▇▇ Use. ▇▇▇▇▇▇, its successors and assigns, may subject all Products or Work to further manufacture, may combine them with other articles, or sell or put them to any use whatsoever, and no claim for royalties or additional compensation may be made by Seller or anyone also by reason of such manufacture, combination, sale or use. All unpatented ideas, information, designs, devices, prints, drawings and technical data concerning Seller’s products, methods or manufacturing processes which Seller discloses or furnishes to ▇▇▇▇▇▇ in connection with this order shall, except only to the extent as may be otherwise specifically agreed in writing by ▇▇▇▇▇▇ and Seller, be deemed to have been disclosed or furnished as part of the consideration for this order, and Seller agrees not to assert any claims by reason of ▇▇▇▇▇▇’▇ use, duplication or disclosure thereof.
▇▇▇▇▇▇▇ Use. The requester acknowledges that any information provided is solely for the purposes of Authorized Use. The requestor agrees that it: (1) will not use the information for any other use; (2) will keep the information confidential at all times; (3) will not copy or modify the information without the authorization in writing from the LIBC. The requestor shall limit its disclosure of the information to employees within its own organization who have a legitimate need to receive such information in order to accomplish the Authorized Use.
▇▇▇▇▇▇▇ Use. The contents of this Site may not be transmitted, transcribed, reproduced, stored or translated into any other form without our prior written permission. However, we permit you to display the content of this Site on your computer or device as part of your viewing of the Site only.

  • License; Use Upon delivery to an Authorized Person or a person reasonably believed by Custodian to be an Authorized Person of the Fund of software enabling the Fund to obtain access to the System (the “Software”), Custodian grants to the Fund a personal, nontransferable and nonexclusive license to use the Software solely for the purpose of transmitting Written Instructions, receiving reports, making inquiries or otherwise communicating with Custodian in connection with the Account(s). The Fund shall use the Software solely for its own internal and proper business purposes and not in the operation of a service bureau. Except as set forth herein, no license or right of any kind is granted to the Fund with respect to the Software. The Fund acknowledges that Custodian and its suppliers retain and have title and exclusive proprietary rights to the Software, including any trade secrets or other ideas, concepts, know-how, methodologies, or information incorporated therein and the exclusive rights to any copyrights, trademarks and patents (including registrations and applications for registration of either), or other statutory or legal protections available in respect thereof. The Fund further acknowledges that all or a part of the Software may be copyrighted or trademarked (or a registration or claim made therefor) by Custodian or its suppliers. The Fund shall not take any action with respect tot the Software inconsistent with the foregoing acknowledgement, nor shall the Fund attempt to decompile, reverse engineer or modify the Software. The Fund may not ▇▇▇, sell, lease or provide, directly or indirectly, any of the Software of any portion thereof to any other person or entity without Custodian’s prior written consent. The Fund may not remove any statutory copyright notice or other notice included in the Software or on any media containing the Software. The Fund shall reproduce any such notice on any reproduction of the Software and shall add any statutory copyright notice or other notice to the Software or media upon Custodian’s request.

  • Data Use Each party may use Connected Account Data in accordance with this Agreement and the consent (if any) each obtains from each Connected Account. This consent includes, as to Stripe, consent it receives via the Connected Account Agreement.

  • System Use (a) An electronic site access system may be used on site, subject to the requirements of this statement. (b) The system operates via: (i) a facial recognition device; and (ii) an electronic gate. (c) The system will be installed at the access and egress point/s of the site and will only be utilised to identify presence on site. (d) The purpose for which the electronic site access system will be implemented is to ensure: (i) avoiding unauthorised access to site; (ii) confirmation and co-ordination of effort in emergency situations; and (iii) confirmation that all entrants to site have received a site specific induction; (e) The only personal data collected by the system is a site entrant’s: (i) image; (ii) first & last name; (iii) mobile phone number; (iv) email address; and (v) employer’s name. (the Collected Data) (f) The Collected Data will only be held or used for the purposes specified above, unless otherwise by consent or required by law. (g) The Employer will not use the electronic site access control system to verify who was on a site at a particular time for the purpose of: (i) evaluating whether a variation claim regarding labour costs made by a subcontractor can be substantiated; (ii) taking disciplinary action against an Employee, or assisting a subcontractor to take disciplinary action against its own employees, regarding their start and finish times; or (iii) otherwise generally tracking a worker’s movements whilst on the site.

  • Intended Use Customer will use Software in accordance with its intended use, instructions for use and all applicable Software labeling as described in the Documentation and the Offer. Customer is responsible for ensuring that the way that it uses Software complies with all applicable laws and regulations.

  • Public Use The Recipient will ensure that Infrastructure resulting from any Eligible Project that is not sold, leased, encumbered, or otherwise disposed of, remains primarily for public use or benefit.
